A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities.

The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, a 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. People outside everyday without shade or rest breaks and has nowhere to keep their insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up.

Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.

My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

Has there been or will there ever be upstream fuel testing of methane gas to anticipate the composition of these fuel cells' emissions? How exactly will NMED enforce emissions standards without direct, long-term, continuous monitoring? Or isolate their deleterious impact on air quality without an accurate assessment of localized pollution?

A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC.

A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance.

We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the statistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence.

Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you.

It is deeply concerning that outside...↓ corporate interests and high powered lobbyists appear to wield an unfair amount of influence over our state regulatory processes, pushing massive infrastructure developments forward without genuine equity, transparency, or regard for the local communities that will bear the heavy burden of their environmental footprint. We cannot continue to allow backroom corporate agendas to put New Mexico's precious and vulnerable natural resources at risk. We have seen this exact dynamic play out across the country such as the devastating strains placed on clean water supplies and local grids in states like Georgia where massive data centers were recently constructed. New Mexico cannot afford to repeat those disastrous, industry first mistakes.
The New Mexico Environment Department's official mission is explicit: "to protect and restore the environment and to foster a healthy and prosperous NM for present and future generations." The NMED Air Quality Bureau is specifically tasked to ""protect the public health of New Mexicans and the natural beauty of the state by preventing the deterioration of air quality."" To uphold this vital mandate, I urge NMED to reject corporate lobbying pressures and take the following actions:
This permit should be denied outright, particularly given Bloom Energy's deeply troubling history of illegal dumping of hazardous waste. Our community should not be forced to trust a corporation with a track record of violating environmental safety laws.
The public must be given an additional 60 days to thoroughly review and comment on this air quality permit. This extension is absolutely necessary so that everyday community members have the time and resources to participate equitably in a process that directly impacts their health.
If the permit is not denied immediately, NMED must mandate a formal public hearing to be held directly in Santa Teresa. To ensure true equity and community inclusion, this hearing must be conducted in both English and Spanish, and must feature a robust option for residents to participate virtually.
Approving this permit would be a direct act of government sponsored environmental racism. The residents of Doña Ana County are already disproportionately impacted by systemic environmental pollution. For years, Doña Ana County has been designated a "nonattainment" zone, meaning our local air quality consistently fails to meet federal safety rules. Forcing a massive new industrial project into an already overburdened community is a profound injustice.
New Mexico's air, water, and community health belong to its people not to the multi billion dollar entities trying to bypass local well being for private profit. I implore NMED to stand with New Mexicans, reject this permit, and protect our future.

We barely have the resources to support families in New Mexico. An AI data center should not even be considered to be built on New Mexicos land. The Rio Grande has been dried up this summer and heat waves have made it difficult to carry out daily life, a AI center creating more heat, more drought, and more waste should not be in New Mexico.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities.

The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. My parents works outside everyday without shade or rest breaks. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels.

Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.

My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

I specifically want to amplify the voices of the direct residents of New Mexico, in which the construction of this data center will harm by providing a comment of their own: A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance.
We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the statistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence.
Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution.
Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you. Please heed the outrage of the average person so visibly in opposition to AI and the construction of data centers. We didn't ask for it and we don't need it.

The proposed design has an individual exhaust stack on each fuel cell, of which there will be 2,275. It would be inefficient to place monitors and controls on each individual stack and there are NO proposed pollution controls on any of these stacks. ...↓How, then, will this project show evidence of their compliance with emissions limit requirements under Title V? Has there been or will there ever be upstream fuel testing of methane gas to anticipate the composition of these fuel cells' emissions? How exactly will NMED enforce emissions standards without direct, long-term, continuous monitoring? Or isolate their deleterious impact on air quality without an accurate assessment of localized pollution?
A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC.

Please, for once, just think about more than what is going to go into your bank account. 10 million tons of carbon dioxide annually for a data center? You know it's common for carbon dioxide to stay in our atmosphere for 20 to 200 years. You know how...↓ much heat 10 million tons of carbon dioxide annually will produce on our planet, which is still trying to heal from the effects of the global warming surge back in the 2000s. You know how many waterways and rivers will dry out because of that heat. You know that New Mexico has the lowest water-to-land ratio in all the states and is already threatened by contaminants, both artificial and natural. You know that over 6 million people in Mexico and Texas live off of waterways like the Rio Grande. You know, there will be children forced somehow to learn while a data center emits noise pollution so loud that the schools that are almost 5 miles away would still be able to hear it. You know how many native animals and plants will have to suffer as if the planet weren't their home too.

You know all of this and still fight to make building a data center the right thing? What is the point of it when people get sick, injured, or even worse, die? Don't you already see the destruction and hurt data centers are causing, and your response as someone who is promising to "invest in the environment" is to make the largest one of these centers. This planet, this floating rock, is all we have. I wouldn't be thinking of AI tools if I were fighting heat stroke, dying from dehydration because there was no water, or hearing about the next species that has gone extinct because it had lost its natural habitat. This all may seem like over exaggeration to you, but it's a life sentence to others. Just take a real look at who you are trusting. Bloom Energy was fined for improper hazardous waste handling in Pennsylvania and Maryland, and yet we are trusting them to build an "environmentally friendly" data center. Doesn't that just sound ridiculous?

This isn't to shame anyone but to truly open your eyes. This is real and going to happen if we don't do something about it. We can no longer just sit and wait because this will affect our planet in a way we can never fully turn back when it is done. I'm sick and tired of hearing people point out these important issues as if they are something that is too late to fix, as if we are a lost cause, as if this one earth isn't our home, basically putting a finish line in the middle of the race. So I beg of you, fight, write more comments and posts, oppose the spread of misinformation, protest, learn and share, do whatever you may to make them wake up and understand this is our chance, that we are real voices, and we will not finish here.
