I live here with many generations of my family and this is our home. I want to continue raising my children here know...↓ing they have a safe and secure future. That future is under threat with this proposed air quality permit. A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up.

The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably.
The air quality permit application should be denied outright given Bloom Energy's history of illegal dumping hazardous waste. Approving this permit would be government-sponsored environmental racism directed at residents of Doña Ana County.
If the permit is not denied outright, a public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually.

This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC. A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit.This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance. We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. The project's proposed fuel cell powered grid is concerning for many reasons: • The proposed "micro" grid has a 2,462 MW Capacity. For comparison, the El Paso Electric grid is about 2,900 megawatts (which services NM's second largest city, Las Cruces) and the entire PNM grid is about 2,700 megawatts. Each of those grids include a substantial amount of renewable energy sources and each of those grids has lower total greenhouse gas pollution than just Project Jupiter's proposed power plant. • This is more greenhouse gas pollution than New Mexico's three largest cities combined – Albuquerque, Las Cruces, and Santa Fe. • Santa Teresa Elementary and High School are located within five miles of this project site. 96% of students at the high school are hispanic. There are also day care centers located within miles of this site. This is an environmental injustice to these children who are especially vulnerable to the health impacts of NOX, CO, and VOCs. • Fuel cell technology has not been deployed at this scale. This is 1000 times larger than the largest existing Bloom fuel cell installation. • The Application is based on pollution testing from a very small unit. The testing unit is only 65kw, while the power plant is 37,000 times that size. • Fuel cells generate hazardous waste. Fuel cells filter out sulfur and other contaminants in the methane stream. These contaminants accumulate as hazardous waste in "desulf canisters." The power plant will be generating enormous amounts of hazardous waste. Jupiter claims that any pollution from opening and changing the filter media in the desulf canisters is exempt from air permitting regulations * (because there is less than 1000 lbs/yr). * NMED's mission is "to protect and restore the environment and to foster a healthy and prosperous New Mexico for present and future generations." Granting these permit applications is a direct contradiction to that mission. I urge the NMED to outright reject YUCCA Yucca Growth Infrastructure, LLC's air permit application for the YGI Microgrid. If NMED does not reject the permit, I ask the department to please hold a bilingual hybrid public hearing near the Santa Teresa community, so that residents can learn about the risks associated with fuel cell technology. Out of these 10,000 comments...↓, thousands upon thousands are from individuals of a strong community who are urging you to reject this project. Today I too write to you in order to strongly urge you to reject the proposed AI data center and everything associated with it and its proposal.

This project poses extreme danger to the people, wildlife, and entire environment of New Mexico. It poses extreme harm to your own people and children. It poses extreme danger to your own plants and animals. It poses extreme danger to your own land that your own feet walk upon.

This project will produce large amounts of greenhouse gasses and toxic waste directly adjacent to schools and residential areas. It will also create a large amount of noise pollution. Both of these will put the people of the Doña Ana community in extremely poor conditions for their health. It will harm everyone. It will harm the adults, the children, and the elderly. It cannot be more important that you realize that these companies are willing to put the health and even the LIVES of men, women, and children at risk, just so they may get more and more money for themselves and their shareholders. It will harm the wildlife, it will harm the ecosystem. Even still, Bloom Energy, one of the companies behind this project, has a history that is less than savory regarding their illegal hazardous waste disposal methods, the truth about their work and what they are, and how they present themselves. These companies do not care about the wellbeing of the people, and the people clearly do not support this Data Center being built by a vast majority.

Despite this, the companies behind this project, knowing that their proposal is not getting the support they want, must resort to playing dirty. They must resort to falsifying comments of support by soliciting the people of New Mexico for their opinion of the matter and their contact information, only to submit fake comments of support under said people's names without their consent. They have been caught doing so, reported on the news for doing so, faced a lawsuit for doing so (and for a number of other matters). They continue to refuse to speak on these matters when questioned, and continue to be desperate for the support they are not getting. It is no surprise that living people are not willing to put the health of themselves, their families, their friends, their community, and their environment at risk for the sake of AI and rich people who would never do the same for them. At their core, these companies are dishonest. If this project was truly as good as they made it out to seem, they would be straightforward about how they will manage the waste produced by the proposal. They would not need to falsify support for their project. They would not need to resort to paying Instagram influencers thousands to support them. They would not be facing lawsuits against their practices and how they are harming the people. They would not suddenly lose their voices when they are confronted with the hard questions. That is the simple truth.

For these reasons, myself and thousands of others are sharing out voices with you to encourage you to reject Yucca Growth Infrastructure, LLC-YGI Microgrid Air Quality Construction Permit Application. This project puts the state at risk, and risks the health and futures of children. There is no true reason that would ever be worth that. The people of New Mexico are not guinea pigs to be tested on or fools to be lied to. We as a community beseech you to outright reject this project.

The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably. If you will not outright reject this project and permit, a public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually.

New Mexico is a beautiful and welcoming state. But we are not sorry to say that we do not want these companies or their AI data centers in Santa Teresa, in Doña Ana County, or anywhere in New Mexico. Thank you for your time and consideration.

I live in Southern Doña Ana County and under no circumstances do I want experimental technology deployed at an unprecedented scale in my backyard. Yucca Growth Infrastructure's gas-powered fuel cell plant is 1,000 times larger than Bloom Energy's big...↓gest existing fuel cell plant. In fact, worldwide, Bloom Energy has developed 1.4 GW of fuel cell technology across more than a thousand locations, yet Yucca Growth Infrastructure is asking for nearly double that (2.46 GW of fuel cells) at a singular location. The largest fuel cell plant in the entire world is more than 30 times smaller than the fuel cell plant under consideration in Santa Teresa. There is absolutely no way to know, with certainty, what the actual pollution levels will be given the tremendous size differential, and thus gap in data, between operational fuel cell plants and this theoretical plant proposed by Yucca Growth Infrastructure. Betting the livability of our county on this unpredictable and unproven plan would be a total capitulation and betrayal of your so-called values: "protects the public health of New Mexicans...by preventing the deterioration of air quality;" "protect and restore the environment...foster a healthy NM for present and future generations"

Though approximations of annual air pollution were provided, the testing used an extremely weak methodology leaving us, ultimately, with pseudoscientific guesses that have large margins of error. Estimated pollution levels for this gas-powered fuel cell plant are based on only three 4-hour pollution tests from a very small unit (only 65 kW). This is a far cry from thousands of sweltering fuel cells operating 24/7 at maximum output in close proximity, all in the scorching heat of our open desert. The lack of rigorous testing at even this small of a scale is lazy and very concerning, especially given that the gas power plant Yucca Growth Infrastructure wants to build is 37,000 times bigger than this unit.
What about cases of catastrophic failure? Are we approving those deadly incidents of pollution in advance without any real data informing us of the risks at this scale? Highly flammable hydrogen under high pressure only needs a microscopic crack to leak out, ignite, explode, and level entire neighborhoods and schools while sending shockwaves into nearby counties. Assuming this risk, an act of gross negligence, at a scale that has never even remotely been demonstrated in practice would be unbelievably careless. These permits must be denied outright. If further deliberation is desired, a public hearing in Santa Teresa is non-negotiable.

A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC.

A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance.

We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the statistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence.

Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you.

The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably.
The air quality permit application should be denied outright given Bloom Energy's history of illegal dumping hazardous waste. Approving this permit would be government-sponsored environmental racism directed at residents of Doña Ana County.
If the permit is not denied outright, a public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of. My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

Granting a permit to emit over 10 million metric tons of CO2 annually violates NMED's mission t...↓o protect public health and prevent air quality deterioration, disproportionately harming BIPOC and low-income communities. The application relies on an unproven, unregulatable, and inadequately tested design: * Unprecedented, Unproven Scale: YGI proposes using 2,275 Bloom Energy Solid Oxide Fuel Cells (SOFC). Though several projects have been announced with much fanfare, the largest operating Bloom installation is a 40 MW facility - 60 times smaller than what is proposed here. Scaling this technology to a mega-utility application remains entirely unproven. * Suspect Estimates & Inadequate Testing: The emissions data provided is based on testing of a single, 65 kW unit four times for four hours. Extrapolating data from a unit 37,876 times smaller than the proposed plant capacity - and adjusting it with an arbitrary 15% safety margin - fails to provide credible empirical evidence. The emissions data provided by the company cannot be trusted. * Enforcement Impossibility: The design routes 2,275 individual cells through separate stacks with no add-on pollution control mechanisms or integrated continuous monitoring for particulate matter, VOCs, or shifting CO2 intensity. NMED cannot practically enforce compliance under 20.2.72.210 NMAC across thousands of individual, degrading units. * Severe Public Health & Environmental Impacts: The microgrid will emit 161.2 tons/year of CO and 124 tons/year of VOCs near existing EPA non-attainment zones. It will generate a thermal plume and a "heat island" effect, raising downwind temperatures by up to 3.6°F in a sweltering desert climate, threatening vulnerable populations. Furthermore, concentrating 10M metric tons of climate-warming CO2 into 275 acres- exceeding the combined emissions of Albuquerque, Santa Fe, and Las Cruces - creates localized health risks. Emerging 2025–2026 research links elevated CO2 levels to permanent changes in human blood chemistry, oxidative stress, and cognitive decline. Because CO2 sensitivity exists on a normal spectrum, even minor baseline increases can induce anxiety and panic attacks in sensitive individuals. Viable alternatives exist. The June 2025 Lazard Levelized Cost of Energy Report confirms that renewables are the lowest-cost resources to deploy and tech leaders are already powering massive data centers using firm solar-wind-battery configurations. YGI must not be allowed to greenwash a fossil-fueled plant that erases New Mexico's climate progress. NMED must reject this permit, or at the very least schedule a formal public hearing to investigate these severe community impacts.
