The proposed design has an individual exhaust stack on each fuel cell, of which there will be 2,275. It would be inefficient to place monitors and controls on each individual stack and there are NO proposed pollution controls on any of these stacks. ...↓How, then, will this project show evidence of their compliance with emissions limit requirements under Title V? Has there been or will there ever be upstream fuel testing of methane gas to anticipate the composition of these fuel cells' emissions? How exactly will NMED enforce emissions standards without direct, long-term, continuous monitoring? Or isolate their deleterious impact on air quality without an accurate assessment of localized pollution? A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC. A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance. We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the statistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence. Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you.

Let me be respectful but blunt: in my opinion, any support form you favoring Project Jupiter is a blatant betrayal of southern New Mexico. The risks to our air, water, and health far outweigh the benefits the developers are promising.

My opposition ...↓is based on the project's own filings and on independent reporting:

- The power plant would emit roughly 10 million tons of greenhouse gases every year — more than Albuquerque, Las Cruces, and Santa Fe combined. A single facility would erase much of the climate progress New Mexico has made over the last two decades.

- The developers' switch from gas turbines to Bloom Energy fuel cells has been marketed as "cleaner," but the plant would still burn natural gas and still produce those emissions. The Center for Biological Diversity has called the change essentially greenwashing.

- Bloom's fuel cells concentrate contaminants like benzene into filter canisters that become hazardous waste. The EPA has fined Bloom more than $1 million for mishandling this waste at other sites.

- This plant escapes the renewable-energy requirements of New Mexico's Energy Transition Act only because state law exempts "microgrids" — even though this one would out-generate the state's largest utility.

- Santa Teresa and Sunland Park already fail to meet federal air-quality standards. This is a predominantly Hispanic border community, with schools and day cares near the site, and in a desert already stretched thin on water.

I understand that New Mexico is hungry for investment and needs to strengthen its economy — I don't dismiss that. But there are far better alternatives. New Mexico has abundant solar and wind resources, and solar and wind paired with battery storage are now the least expensive source of new electricity. We can attract investment without locking our region into decades of fossil-fueled pollution.

I know several state senators have already raised concerns about this project. I respectfully ask you to (1) publicly oppose this air permit, (2) press NMED and the Governor to hold a bilingual, in-person public hearing here in the Santa Teresa/Sunland Park area and to extend the public comment period, and (3) support closing the "microgrid" loophole so facilities this large must meet the same clean-energy and pollution standards as utilities.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.

My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

We are in the middle of an extre...↓me heat wave due to climate change. It is unconscionable to approve a plan that would dwarf the CO2 emissions of the residents of the county.

What pollution controls are in place? How did the developers arrive at the numbers on their permit if there has been no plant close to this size? What are the safeguards for our health and our children's health if these estimates are incorrect?

The emission estimates of the plan as has been submitted are already unacceptable. There is too much at stake in the uncertainty of the reality of the project.

The mission statement of your department says that your mission is to protect and restore the environment and to foster a healthy and prosperous New Mexico for present and future generations. How are you sure that this will ensure a healthy and prosperous New MExico for future generations?

You cite four tenets to uphold this mission:
Science: "Using the best available science to inform our decision-making in protecting public health and the environment." What rigorous, independent science has gone into the claims of this permit?

Innovation: "Employing creative engineering and technological solutions to address environmental challenges."
If Project Jupiter claims that its new permit reduces the carbon emissions by 67% and NOx emissions by 92 % as they claim, why can't a $1.65 Billion project fund a completely carbon neutral energy solution?

Collaboration: "Engaging communities and interested stakeholders in environmental decision-making outcomes."
How many letters have you received showing that the vast majority of the community does not want this project? How many letters that were not paid for by Project Jupiter have been submitted in support of this project?

Compliance: "Ensuring meaningful compliance with state regulations and permits; leveling the playing field through enforcement."

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.

My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

The fuel cells will release a big amount of carbon dioxide, anticipated that more than 10 million tons of carbon dioxide. Can you see how much of the problem that already is? Just now the temperature of the world has risen from greenhouse effect. Even Europe where then temperatures rarely rose over 30 during the summer had now reached over 30°C, in some countries it even reached 40°C. You cannot convince me that having ONE MORE of the largest data centers won't affect anything and won't make the world dying faster. We have over 10,000 data centers, NOT having one more won't kill us, we have been existing way longer than that. Way before these things even started. We can live without data centers and AI, but we cannot live without clean water and the earth. This Project Jupiter is threaten the limited resources of water we depend on to keep living. If this project actually happens and continues, the developers and governments decided to sacrifice the lives of innocence for an uncertain future, it won't be just us or the lower classes that won't survive, it will be everyone. Including the plants, the animals, those who let this happen, the greed for power shall be the death of everyone including those who held the power.

The fact that this project has more invest, the sum of 165 billion US dollars while out there there is a school being shot up, families being separated just because they're 'illegal', children and women being violated and have no rights is very concerning. More surprisingly, no one takes care or bat an eye at those problems. You can try and tell me that this Project Jupiter will change life to the better, providing jobs, opportunities and benefits for the locals and portray the goods of what this will do to the world, but everyone knows the truth. If anything this will destroy even more of what we have. The world already dying enough, not even slowly anymore. We wanted to help stopping and slowing it down, not making it faster.

I may be young, 'inexperienced in life' and my comment might seem to make no sense to you, but in this moment I am also just another human who wanted to live and see the world in future. With this project and many more projects coming for earth's resources, all the younger generations WILL have an uncertain future of whether they will get to see the world tomorrow or will it be gone before they can even speak. The communities of people who do not even agree to this happening will have to pay their price for generations, even after the developers who created this are long gone. You might not see the problem now, but in near future my and many others complains won't be just another protest. It will be the problem everyone has to face, but no one dare to deal. We will not give up, even when we are losing hope. We want and need this project to stop. I will not be trusting a word the developers of this project say, no matter how good the benefits sounded. We only have one earth, we cannot find new planet to replace this and we already destroyed our planet more than half of it. Now we have to pay the price and rebuild the earth together, not continuing to ignore and create whatever data center is.
