A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of. My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

While Project Jupiter has been promoted for its economic benefits, I believe New Mexico has an opportunity to pursue a stronger alternative. Chris Lyons, the applicant and property owner for the Project Jupiter zoning approval, already controls a significant amount of land in Santa Teresa. This presents a unique opportunity to power the project with large-scale renewable energy infrastructure rather than an emissions-producing fuel-cell microgrid. Such an approach could create lasting workforce opportunities, strengthen New Mexico's energy future, and better protect public health, air quality, and the environment while advancing the state's long-term clean energy goals.

The proposed fuel-cell microgrid would emit carbon dioxide and other air pollutants while relying on technology at an unprecedented scale that would also generate hazardous waste requiring long-term management. Recent scientific research has linked elevated carbon dioxide exposure to measurable changes in human blood chemistry, increased oxidative stress, and cognitive effects. As the agency charged with protecting New Mexico's air quality and public health, I urge NMED to carefully consider these potential impacts on surrounding communities when evaluating this permit.

New Mexico has committed to expanding renewable electricity through the Energy Transition Act. Project Jupiter presents an opportunity to advance those goals while supporting long-term economic development through cleaner infrastructure rather than investing in a system that will continue producing emissions for decades.

If the permit is not denied, I respectfully request that NMED hold a bilingual public hearing in or near the Santa Teresa community, with a virtual participation option, so residents, neighboring Tribal governments, and other stakeholders have a meaningful opportunity to participate in this decision.

My parents don't remember a...↓ time growing up where the Rio Grande was dried up for weeks at a time. In my lifetime, it comes with little fanfare. Because of this, I ask you to deny the Yucca Growth Infrastructure's air quality permits. New Mexico does not need more pollution. Project Jupiter is expected to release 10 million tons of carbon pollution into our airs, and therefore, into surrounding fragile environments, in addition to taking up hundreds of thousands of gallons of water that surrounding communities could benefit from receiving instead. Additionally, in communities that already live near data centers across the United States, many complain of constant humming noise that disrupts the ecosystem, drops in water pressure in surrounding suburban households, unknown smog coming from chimneys leeching pollutants into the air with no response from the companies themselves, and unclean tap water. These data centers may claim that they will leave no impact on surrounding communities, but how will we guarantee this is true? How will we guarantee the safety of Doña Ana County residents, when Doña Ana County has already been labelled as a "nonattainment zone", and therefore already do not meet several air quality regulations. Furthermore, Bloom Energy already has a history of illegally dumping hazardous waste. In such a fragile environment, how could this waste impact our biodiversity, or at worst, at what risk could this leave if this waste seeps into our precious groundwater? Our infrastructure for making sure our people have access to clean water in this state is already fragile. Think to a decade ago, when communities in northern New Mexico who relied on the Animas River were terrified that a precious water source had been taken from them.
The public should be given an additional 60 days to review and comment on this air quality permit. The people of Doña Ana County deserve the chance to let their voices be heard, and if the permit is not denied, there needs to be a public hearing held in Santa Teresa, in both English and Spanish, to further allow the community to speak on this matter. When looking at this permit, ask yourself, do the benefits outweigh the risks on the community? Why should Doña Ana County residents suffer from this government-sponsored environmental destruction and racism. If Doña Ana County already struggles to meet federal government rules on air quality, how does Project Jupiter serve to make it any better? The simple fact is that it won't. Even with the money that Project Jupiter pledges to give to surrounding communities, there is still the strong estimation that it will produce ten million tons of carbon dioxide. Ten million tons, released into the atmosphere and into the air of surrounding communities. Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you. Project Jupiter does not exist in a vacuum. Its environmental damage will be overwhelmingly negative, and it risks our most vulnerable in the process. To reiterate, a data center as large as Project Jupiter does not yet exist, nor does data for its environmental damage exist either. We are risking our communities for something that we have no proof will be safe for our residents to live beside. It is not worth the risk. Deny Project Jupiter's air quality permits, or guarantee harm to its surrounding communities and environment.

While this project is being presented as an economic opportunity, I do not believe the proposed benefits outweigh the long-term risks to ou...↓r region. Doña Ana County and Southern New Mexico do not have unlimited resources. We live in a desert. Water is already one of our most precious and strained resources, and many communities in our region still struggle with reliable access to clean, safe water. It is deeply troubling to consider bringing in a massive industrial data center project when basic water security has not been solved for the people who already live here.

The same concern applies to energy. Whether the project uses the public electric grid directly or relies on a separate microgrid, the energy demands of a project this large are enormous. Our region should not be asked to carry the environmental, infrastructure, air quality, land-use, and long-term resource burden of powering artificial intelligence operations for some of the largest corporations in the world.

The number of permanent local jobs promised does not justify the scale of this project. Temporary construction jobs are not the same as long-term, stable employment for local families. Even the permanent jobs being discussed are not enough to balance the potential strain on our water, air, energy systems, roads, public services, and quality of life. A project of this magnitude should bring extraordinary and guaranteed public benefit. Instead, the community is being asked to accept extraordinary risk.

I am also concerned about the lack of transparency and the way the project has continued to change as public concern has grown. When a project's water use, power source, emissions, and infrastructure plans continue to shift, the public cannot meaningfully evaluate what is actually being approved. Doña Ana County residents deserve clear, independent, enforceable information before any further permits, incentives, or approvals are granted.

This is not opposition to technology or economic development. It is opposition to the wrong project in the wrong place, at the wrong scale, without adequate protection for the people, water, land, air, and future of Southern New Mexico.

Our region should be investing in sustainable industries that strengthen local communities without exhausting the resources we all depend on. We should not sacrifice our water security, air quality, land, and public trust for a project whose benefits are uncertain and whose burdens may be carried by generations of New Mexicans.

I respectfully urge decision-makers to deny, pause, or reconsider all approvals and permits related to Project Jupiter until full independent environmental, water, energy, public health, and economic impact studies are completed and made available to the public. Any project of this size must be judged not by corporate promises, but by enforceable protections for the people of Doña Ana County.

For these reasons, I oppose Project Jupiter.

Yucca Growth Infrastructure's gas-powered fuel cell plant is 1,000 times larger than Bloom Energy's big...↓gest existing fuel cell plant. In fact, worldwide, Bloom Energy has developed 1.4 GW of fuel cell technology across more than a thousand locations, yet Yucca Growth Infrastructure is asking for nearly double that (2.46 GW of fuel cells) at a singular location. The largest fuel cell plant in the entire world is more than 30 times smaller than the fuel cell plant under consideration in Santa Teresa. There is absolutely no way to know, with certainty, what the actual pollution levels will be given the tremendous size differential, and thus gap in data, between operational fuel cell plants and this theoretical plant proposed by Yucca Growth Infrastructure. Betting the livability of our county on this unpredictable and unproven plan would be a total capitulation and betrayal of your so-called values: "protects the public health of New Mexicans...by preventing the deterioration of air quality;" "protect and restore the environment...foster a healthy NM for present and future generations" Though approximations of annual air pollution were provided, the testing used an extremely weak methodology leaving us, ultimately, with pseudoscientific guesses that have large margins of error. Estimated pollution levels for this gas-powered fuel cell plant are based on only three 4-hour pollution tests from a very small unit (only 65 kW). This is a far cry from thousands of sweltering fuel cells operating 24/7 at maximum output in close proximity, all in the scorching heat of our open desert. The lack of rigorous testing at even this small of a scale is lazy and very concerning, especially given that the gas power plant Yucca Growth Infrastructure wants to build is 37,000 times bigger than this unit. A 15% "safety margin" was added to the numbers provided by the applicant. Safety margins are not usually added if a company is confident in the accuracy of their pollution estimates. Even small variations from this superficial test will result in massively different levels of pollution and given that the plant will be 37,000 bigger than the testing unit, a 15% safety margin is completely insufficient–it could work as a margin for a single unit, but not the entire plant. If a unit has a 0.01% chance of failing (sounds promising right?), the odds of 37,000 of those units working perfectly at the same time is 2.47% (pathetically low feasibility). That means there is a 97.53% chance that the plant will experience at least one failure. What will the exact level of redundancy be? Will more fuel cells be rubberstamped or pollution levels overlooked in five years or less due to age-related inefficiencies? What about cases of catastrophic failure? Are we approving those deadly incidents of pollution in advance without any real data informing us of the risks at this scale? Highly flammable hydrogen under high pressure only needs a microscopic crack to leak out, ignite, explode, and level entire neighborhoods and schools while sending shockwaves into nearby counties. Assuming this risk, an act of gross negligence, at a scale that has never even remotely been demonstrated in practice would be unbelievably careless. These permits must be denied outright. If further deliberation is desired, a public hearing in Santa Teresa is non-negotiable.

What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit.
This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance. We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the statistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence. Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you. The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably. The air quality permit application should be denied given Bloom Energy's history of illegal dumping hazardous waste. If the permit is not denied, a public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually. Approving this permit would be government-sponsored environmental racism as residents of Doña Ana County are already disproportionately impacted by environmental pollution. For years, Doña Ana County has been called a 'nonattainment' zone— this means our air quality does not meet federal government rules.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years.

The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably.
The air quality permit application should be denied outright given Bloom Energy's history of illegal dumping hazardous waste. Approving this permit would be government-sponsored environmental racism directed at residents of Doña Ana County.
