I am a retired teacher, have lived in Las Cruces all my life, and believe that our environment here needs to be protected. So I bought solar panels 17 years ago t...↓o reduce my individual carbon footprint, and the planned data center's emissions would dwarf the CO2 emissions of the residents of the county.

I think the process needs to be slowed down so that the residents of Doña Ana County have the opportunity to have their many questions answered.

What pollution controls are in place? How did the developers arrive at the numbers on their permit if there has been no plant close to this size? What are the safeguards for our health and our children's health if these estimates are incorrect? The emission estimates of the plan as has been submitted are already unacceptable. There is too much at stake in the uncertainty of the reality of the project. Let's do this right. Let's build the initial infrastructure from renewable energy resources like solar and wind and then phase in the data center. In social media I have seen a great deal of money spent in support of Project Jupiter. I hope that you will listen to more than the money.

A friend's daughter and former student of mine sent me the link to make this entry and included this in her letter which I would like to quote directly:

"The mission statement of your department says that your mission is to protect and restore the environment and to foster a healthy and prosperous New Mexico for present and future generations. How are you sure that this will ensure a healthy and prosperous New Mexico for future generations?

You cite four tenets to uphold this mission:
Science: "Using the best available science to inform our decision-making in protecting public health and the environment." What rigorous, independent science has gone into the claims of this permit?
Innovation: "Employing creative engineering and technological solutions to address environmental challenges." If Project Jupiter claims that its new permit reduces the carbon emissions by 67% and NOx emissions by 92 % as they claim, why can't a $1.65 Billion project fund a completely carbon neutral energy solution?
Collaboration: "Engaging communities and interested stakeholders in environmental decision-making outcomes." How many letters have you received showing that the vast majority of the community does not want this project? How many letters that were not paid for by Project Jupiter have been submitted in support of this project?
Compliance: "Ensuring meaningful compliance with state regulations and permits; leveling the playing field through enforcement." What assurances does the community have that this project will meet state regulations? What plan is in place if it doesn't?

Reject this permit."

She makes some excellent points. We have an opportunity to get this right. Data centers will need to be constructed in the future. Let's wait and do this when we have a plan worth pursuing.

As someone who believes that public institutions exist to safeguard the long-term health of our communities, I am deeply concerned that this project asks New Mexicans to assume substantial environmental and public health risks in exchange for uncertain private benefits. Decisions of this magnitude should be guided by whether they advance the broader public interest and the mission of the Environment Department to protect present and future generations.

Changing the project's name and replacing one technology with another does not change the underlying reality. The proposed facility would still emit enormous quantities of greenhouse gases while introducing fuel cell technology at a scale that has never been demonstrated in practice.

I am also troubled by the project's environmental justice implications. Communities near Santa Teresa, including schools, childcare facilities, and Tribal communities with ties to the surrounding lands, deserve meaningful participation in decisions that could affect their air quality and long-term health.

New Mexico has made important progress toward addressing climate change, and approving a project capable of producing millions of tons of greenhouse gas emissions each year would undermine those efforts. We should not sacrifice decades of environmental progress for a project whose claimed benefits remain uncertain while its environmental costs are substantial.

As someone who has experienced firsthand how environmental and public health issues can profoundly shape quality of life, I believe we have an obligation to apply the precautionary principle when the potential consequences are so significant. Once pollution is released and infrastructure of this scale is built, the impacts cannot simply be undone. Responsible governance requires looking beyond short-term economic promises and considering the lasting effects on the people who will live with these decisions for generations.

For these reasons, I urge the New Mexico Environment Department to reject Yucca Growth Infrastructure, LLC's air permit application. If the Department does not reject the application, I ask that it provide at least 60 additional days for public review and hold a bilingual, hybrid public hearing in or near Santa Teresa so that affected residents have a meaningful opportunity to participate in this process.

Project Jupiter will harm residents of Doña Ana County and will have widespread consequences for the entire State of New Mexico. During a historic drought, the fact that this project is even being considered is a slap in the ...↓face to New Mexicans.

Oracle and OpenAI have spent big money trying to rebrand and greenwash this project, by saying potable water will only be used for office/admin needs, and that Project Jupiter will use non-potable water. New Mexicans are not dumb. We know that non-potable water is essential to our communities continuing to live and thrive–it is the way we grow crops, nourish our flora, and support our wildlife. We also know that water is not the only way to cool data centers–it is simply the least expensive for the operation (but the most expensive for the most affected–us).

In reality, Project Jupiter's water usage is estimated to be nearly one million gallons per day. New Mexicans understand that agua es vida and this is a price we simply cannot afford to pay.

Aside from water usage, the effects of data centers are largely negative for surrounding communities:
The energy demands the site will require will put further strain on our powergrids, thus decreasing stability and increasing prices for New Mexicans.
The generators and cooling units create a constant buzz (louder than 85 decibels) for surrounding communities thus creating inescapable noise pollution.
The 24/7 security lighting creates constant and disruptive light pollution for surrounding residents, wildlife and our skies.
The job creation that is touted is grossly overstated, with permanent operational job opportunities increasing by only 20-50 local jobs per city. Not to mention that only 20% of construction workers currently working on the project are New Mexicans.

Furthermore, with the amount of harm this project does to the community and state, Oracle and OpenAI should be injecting billions of dollars into the community. Instead, local leaders have agreed to let these trillion dollar companies off with ~$500M worth of targeted local reinvestment strategies.

And what is the benefit to New Mexicans? Studies show that the recent increase in construction of data centers is not even to support generative AI, email, social media and other digital activities, but to accommodate the larger IoT growth–namely surveillance! Why are New Mexicans subsidizing the industrial data race for billionaires and trillionaires?

This project is for the benefit of few at the cost of many. We cannot drink data. We cannot water our crops with data. We cannot sustain our wildlife with data. We cannot sacrifice the health and well-being of our most vulnerable communities to subsidize data collection and wealth accumulation of the world's oligarchs.

For this reason, I would like to state on the record that I am firmly against this and any other data center construction in New Mexico. Thank you.
