Though the tech they are presenting as fuel cell tech (in my research) does claim to emit only water, there are many types of fuel cell tech available. Applying for permit for fuel cell tech does not, in itself, tell us what type of tech is being use...↓d. For sake of argument, let's use Hydrogen cell tech. Yes according to the research, water is the emission. But it doesn't address the energy emitted by this hugely exothermic chemical reaction of hydrogen bonding w oxygen. Nor does it address WHERE the fuel (hydrogen) will come from, how it will be transported, stored and safety protocols, if indeed this is what type of fuel cell is being used. Not to mention that fossil fuel is required to obtain pure hydrogen. Pure hydrogen deposits are very rare in pure form, very rare. They are acquired from compounds that must be broken to acquire pure form. To get this an extremely high amount of CO2 is emitted to get pure hydrogen. There are just too many questions that surround this application. To give the public the nice nice PR propaganda that it is zero emissions is misleading and too simple. There are too many questions that I really don't believe the public will ever know and that those politicians that are privy just don't understand. Like how nuclear energy was touted as safe and clean, we found out how delicate maintaining it can be and the danger it poses to the public and environment. We don't know what effects this "clean emission fuel cells" will have in the future to our health and environment. Either way, the water that will be emitted will not be enough to replace the water from our reserves and water table that is needed to be used to cool the cells. I submit my response as a pushback of the fuel cell clean air permit. Too many questions. Use of our already water deprived reserves. And unknown long term dangers to our people and environment. I ask that the public should be given an additional 60 days to review and comment on the air quality permit.

Asking for experts, unbiased, to help the public understand the tech jargon used so we can see past the public image being promoted by the project leaders. Approving this permit would be government-sponsored environmental racism as residents of Doña Ana County are already disproportionately impacted by environmental pollution. Dona Ana county has long been considered a non attainment zone, not meeting federal standards. So why now is Dona Ana an optimal area? I personally feel this permit should be denied considering Bloom Energy's history of illegal dumping hazardous waste. This was associated with solid oxide fuel cells which produce toxic waste that include chromium. Bloom has been called a "large quantity generator of hazardous waste" by the EPA. If Bloom plans to use solid oxide fuel cells, as used in other projects, we can count on high CO2 emissions among other known toxins. Considering that the EPA itself labeled it as a hazardous waste generator, I recommend denial of the permit. Where are their plans to safely and securely hold waste production? Their past has shown that they simply dumped in landfills. I implore that the permit be denied. If not denied, I request public hearing be set in Santa Teresa w expert s to be available to counter the project propaganda. I ask for both English and Spanish and virtual to allow all to provide input. This is an invasion of our land for a data center being built for a surveillance to support the racial agenda of this current administration.

I am submitting this comment to share my strong opposition to the Yucca Growth Infrastructure, LLC-YGI Microgrid Air Quality Construction Permit Application. Please deny this application for the following reasons:

*YGI's application should be denie...↓d by NMED because YGI failed to include all relevant information about Bloom Energy's problematic history. A report provided by Hindenburg Research has indicated the nature of the Bloom Energy company and its systems in other states which have higher emissions than they initially indicated [1]. This report was used in a court case (Jacob v. Bloom Energy Corporation) in Delaware where a shareholder of the Bloom Energy company was demanding an inspection of Bloom's books and records following the analysis of the Hindenburg report on the company [2]. In this case the court concluded granting Jacob limited inspection rights as Bloom's Form 8-K form rebuttal to the Hindenburg report as the form stated that there was an accounting error, giving some credibility to Jacob's concerns on the company's financial reporting [2]. Additionally, the EPA probed and fined the company over its handling of potentially hazardous waste from their solid fuel cells in Delaware which ran on natural gas in 2020 [3]. In fact, the company has a trend of downplaying the hazardous waste, including this year [3].

*Bloom Energy's Fuel Cells are not clean energy – no matter what YGI says. These fuel cells generate significant NOX, CO, and VOCs, all of which contribute to negative health impacts, as well as hazardous solid waste that cannot be ignored by NMED. The amount of greenhouse gases that would be produced is still above the emissions of New Mexico's biggest cities combined despite the fact that the fuel cells will emit about 2 million tons less in emissions than the original gas turbines at about 13 million, according to Bloom Energy's own Doña Ana County website [4]. This does not match the state's push for green and renewable energy as stated by the Energy Transition Act, which has "...set a statewide renewable energy standard of 50 percent by 2030 for New Mexico investor-owned utilities and rural electric cooperatives" [5]. Even the Office for Renewable Energy has a track record for renewable energy as touted by the Office's own state website [6]. However, this project's fuel source is the opposite of what the state's own legislation has set for moving away from nonrenewable and CO2 emitting energy sources. The natural gas powered, fuel cell micro-grid as proposed is almost a completed contrast to other energy projects such as the SunZia and the Iberdrola "El Cabo" projects [6].

*Permitting any microgrid facility will result in a clear example of environmental racism and NMED is required to ensure no group of people bears a disproportionate share of negative environmental consequences [7, 8]. This is especially important because Doña Ana County residents already bear the disproportionate burden of environmental pollution compared to the rest of New Mexico.

*NMED should give the public 60 days of additional time to review and comment on the Application to ensure everyone can meaningfully comment and participate.

Above all, the lack of information including the energy source the fuel cells use to residents in the city where the center will be located and nearby cities is not appreciated and should be taken into account when reviewing the application.
The manner in which information has been given has been seemingly muddy for a more popular result. For one, the manner of information about the project and its power sources lacks clarification for the general public, beyond just media coverage. For example, there is very little information about how the fuel cells are powered. When looking up the fuel cells used by the company, three options are talked about: natural gas, biogas, and hydrogen. But the exact energy type used for the Doña Ana County project's fuel cells has be limited. Few sources actually mention the fuel source, with the information difficult to find. It is not mentioned clearly to the public at all, and the Bloom Energy website mentioned it only under a Q&A about pollutant emittants [4].
There has been promotional material used for the project and the use of fuel cells which have been touting that the fuel cells are clean energy when it is not. Even the Bloom Energy website touts that it is cleaner, but only in air pollutants and not emissions despite the way the project likes to make it out to be clean energy [4]. This specific project for Doña Ana County has stated that the fuel cells will be powered with natural gas, which is in fact not a clean energy source [4]. If the project truly wanted to use clean energy, they would have used solar fuel cells, a different energy source that for the fuel cells such as hydrogen which is cleaner, or a combination of green energy sources. The fact that stating the project is using fuel cells and not specifically mentioning that they are natural gas powered is misleading in nature. Most people hearing the phrase 'fuel cells' will likely correlate it to solar powered fuel cells and the lack of clarification is used to generate a more positive perspective of the project's use of fuel cells to residents who have been pushing back on the project's water usage and emissions rates.
The greenwashing and misleading nature by Bloom Energy should not, and is not, acceptable to the county's and state's constituents which is why I believe that the application should be denied.

In fact, legal and ethical failures are the only consistent...↓ outcomes delivered by this project and its associates thus far. I hope you can even slightly imagine what this same behavior would mean when accompanying the privatized development of an experimental fuel cell plant of unprecedented scale. We know these deceptive practices are common among massive, out-of-state corporations and institutionalized within Doña Ana County and the state government. The decisions you make surrounding this air quality permit will clearly demonstrate whether this body functions as an independent regulatory authority or a charade entrenched in the very political favor that brought this community health disaster to your desks.

Do you know why the department and bureau's mission statements contain the words 'healthy' and 'public health'? Surely you are aware that, fundamentally, environmental contamination undermines human health at best and eviscerates livability at worst– at least that which is humane and dignified. Calculated complacency has left southern Doña Ana County with decades of poor air quality. Consistently ranking in the top 20 most ozone-polluted areas of the country has brought us higher rates of neonatal complications, childhood asthma, and premature death. To even contemplate forcing more pollution into our lungs when you have been so silent about ongoing suffering– so much of which is quite literally in your control– is unbelievable. My HOME– my FAMILY– sits less than 7 miles away from this proposed operation. We have already had high ozone days which trap people indoors with the advice of 'keep the evaporative cooler off' in the midst of blistering heat. You are deciding whether people in my community will live or die because of frivolous hazards that are 100% PREVENTABLE.

Given the applicants' insufficient testing and the technology's complete lack of reliable evidence exhibiting lifetime safety risks or efficiency at a scale that is even remotely close to what is proposed here, the applicants' pollution estimates are certainly the floor of what they will emit. It is an insult to our intelligence and homegrown education to expect us to believe that this theoretical monstrosity and its corporate handlers will respect the boundaries of these rough approximations. Let's remind ourselves of how anemic NM oil & gas regulation is in practice, particularly in terms of illegal venting and undisclosed spills. You are fully aware of ongoing and egregious oversight failures driven by strategic funding choices. With the knowledge that this is a deeply ingrained, statewide status quo at the earliest stages of reform, allowing this permit to move any further would make you complicit in generations of unescapable harm.

You know full well that the denial of this air permit is one of the only leverage points our community has to protect ourselves from expedited exploitation. If you do not stop it here, at the gateway of the very air we breathe and cannot run away from, let alone live without, you are signaling to every predatory corporation in the nation and the world that our agencies are hollow and our health is for sale. The impact of your decision will long outlast you– it can loom over and darken even your greatest accomplishments or cement your integrity in time. If the local, community-based opposition is not enough to indicate the weight of this decision, the choices made by relevant corporations to commit identity theft and fraud via this very comment portal and violate the Open Meetings Act, Inspection of Public Records Act, Lobbyist Regulation Act, and statutory IRB and LEDA application and grantee mandates, should.

If, for a moment, we ignore the fraudulent comments, I already see more than double that of the first permit. That is growing support for our community and growing fear on the part of the project's handlers. The panic of the latter is palpable. If this AIR QUALITY proposal is so beneficial for our community, why resort to illegal activity? Throwing money at communities in Las Cruces that are almost an hour away from the frontline neighborhoods of Sunland Park and Santa Teresa should never be considered an acceptable defense for worsening a chronic nonattainment zone with unproven experiments. This shiny fuel cell façade for methane gas-powered air pollution is a classic marketing ploy. To act like this is better than the prior applications is the industrial equivalent of Big Tobacco's push for vaping as a 'healthier' alternative to smoking cigarettes because it doesn't 'combust' or have an 'open flame'. Would you introduce vaping to children with the idea that it's 'healthier' than alternatives? I hope you don't expect us to allow our children to breathe in a bit of benzene and carbon monoxide here, some nitrogen oxides and smog there, and accept that it's all better than it could've been.

There is absolutely no room for more air pollution or dangerous gas pipelines in our community. Approving this permit would be nothing short of government-sponsored environmental racism. The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably. A public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually. The air quality permit application must be denied given the irreversible health impacts of the applicants' estimated pollution, the technology's complete lack of scientific credibility, and Bloom Energy's history of illegally dumping hazardous waste into municipal waste streams. We already have an epidemic of illegal dumping in the area which has gone underregulated for decades. Inviting a proven bad actor that historically endangers the lives of people it profits from into our community is institutional malfeasance.

You have much more experiential information than our community did when IRBs were initially forced through despite our questions and concerns. Excuses like mistakes and incompetence no longer apply. If this permit to ravage our air moves forward, please have the decency to remove any mentions of health from your mission statements because you cannot possibly represent that word while doing so.
