In fact, worldwide, Bloom Energy has developed 1.4 GW of fuel cell technology across more than a thousand locations, yet Yucca Growth Infrastructure is asking for nearly double that (2.46 GW of fuel cells) at a singular location. The largest fuel cell plant in the entire world is more than 30 times smaller than the fuel cell plant under consideration in Santa Teresa. There is absolutely no way to know, with certainty, what the actual pollution levels will be given the tremendous size differential, and thus gap in data, between operational fuel cell plants and this theoretical plant proposed by Yucca Growth Infrastructure. Betting the livability of our county on this unpredictable and unproven plan would be a total capitulation and betrayal of your so-called values: "protects the public health of New Mexicans...by preventing the deterioration of air quality;" "protect and restore the environment...foster a healthy NM for present and future generations"

Though approximations of annual air pollution were provided, the testing used an extremely weak methodology leaving us, ultimately, with pseudoscientific guesses that have large margins of error. Estimated pollution levels for this gas-powered fuel cell plant are based on only three 4-hour pollution tests from a very small unit (only 65 kW). This is a far cry from thousands of sweltering fuel cells operating 24/7 at maximum output in close proximity, all in the scorching heat of our open desert. The lack of rigorous testing at even this small of a scale is lazy and very concerning, especially given that the gas power plant Yucca Growth Infrastructure wants to build is 37,000 times bigger than this unit.

A 15% "safety margin" was added to the numbers provided by the applicant. Safety margins are not usually added if a company is confident in the accuracy of their pollution estimates. Even small variations from this superficial test will result in massively different levels of pollution and given that the plant will be 37,000 bigger than the testing unit, a 15% safety margin is completely insufficient–it could work as a margin for a single unit, but not the entire plant. If a unit has a 0.01% chance of failing (sounds promising right?), the odds of 37,000 of those units working perfectly at the same time is 2.47% (pathetically low feasibility). That means there is a 97.53% chance that the plant will experience at least one failure. What will the exact level of redundancy be? Will more fuel cells be rubberstamped or pollution levels overlooked in five years or less due to age-related inefficiencies?

What about cases of catastrophic failure? Are we approving those deadly incidents of pollution in advance without any real data informing us of the risks at this scale? Highly flammable hydrogen under high pressure only needs a microscopic crack to leak out, ignite, explode, and level entire neighborhoods and schools while sending shockwaves into nearby counties. Assuming this risk, an act of gross negligence, at a scale that has never even remotely been demonstrated in practice would be unbelievably careless. These permits must be denied outright. If further deliberation is desired, a public hearing in Santa Teresa is non-negotiable.

Has there been or will there ever be upstream fuel testing of methane gas to anticipate the composition of these fuel cells' emissions? How exactly will NMED enforce emissions standards without direct, long-term, continuous monitoring? Or isolate their deleterious impact on air quality without an accurate assessment of localized pollution?

A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC.

A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance.

We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the st atistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence.

Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you.

I am writing to stand with my fellow New Mexicans in Doña Ana County in opposition to the construction of the Project Jupiter data center campus. Across the state, residents and lawmakers alike have expressed deep concerns about the environmental health impacts associated with data center construction, and I share their concerns about the risks and harms Project Jupiter poses to all New Mexicans. I am submitting this comment to urge the New Mexico Environment Department to reject Yucca Growth Infrastructure, LLC's air permit application for the YGI Microgrid in Doña Ana County.

As an educator, I have seen firsthand the negative impacts of increased AI technology on the social-emotional health, motivation and learning of our young people. I am also deeply concerned about the future of our lands and waters and protecting them for the health of future generations. The massive environmental impacts of data centers are well known (https://www.lincolninst.edu/publications/land-lines-magazine/articles/land-water-impacts-data-centers/), and Project Jupiter is no exception in terms of its power needs. While the project's website claims that it will not impact utility bills or water resources in the region due to generating its own power on a "closed loop system," water is still required as an initial input and there are still power and environmental costs associated with a massive construction project such as this one.

Aside from my intrinsic opposition to data centers, I also have concerns about the lack of transparency and public input throughout this process. Not only has the company behind Project Jupiter changed its name and withdrawn previous permit applications because of public opposition, but it has also continued to change proposed energy sources and provide vague claims about the environmental costs and economic benefits (https://www.organmountainnews.com/project-jupiter-senators-listening-session-august-2026/). The current proposal to use fuel cell technology is concerning for many reasons: it still produces high levels of greenhouse gasses and toxic pollutants (the website mentions a 92% reduction in NOx but does not say anything about CO2); there is not a clear process for handling waste; fuel cell technology has not often been tested at the proposed scale; and there are still air quality impacts for surrounding communities like Santa Teresa.

While the current proposal looks better on the web and has all the language of clean, green energy and environmental input, journalistic reporting on similar projects indicate that there is often not a substantial difference in CO2 emissions between natural gas and solid-oxide fuel cells, like Bloom Energy claims, and furthermore that Bloom boxes often require start-up or back-up power generation and thus are not fully self-sustaining. Moreover, if they do run on natural gas that still needs to be extracted and thus contributes to an overall increase in fossil fuel consumption and greenhouse gas emissions that exacerbates the climate crisis.

This is just another example of New Mexico being treated as an environmental sacrifice zone, where development projects with major associated toxic waste and health risks are pushed onto economically and socially vulnerable communities with little opportunity for review or public input. I ask the NMED to hold a bilingual public hearing near the Santa Teresa community (located 3.6 miles from the proposed project) in addition to the State Senators' proposed August 11 listening session, and to reject the air permit application for the YGI Microgrid.

You all hold the institutional responsibility to protect our scarce water resources and the public health of Mexicano, Hispano, and Indigenous communities that will be impacted by Project Jupiter. If Project Jupiter continues, it will be a clear example of environmental racism, especially given Bloomberg's fuel cell microgrid's emissions will continue to pollute our communities with over 10 million tons of CO2. We once again want to remind you that communities on the borderlands have been historically sacrificed for the state's so-called "innovation." These are the same communities that have not had access to clean potable drinking water for years. We cannot prioritize water access and energy demand for Project Jupiter, a project that is neither needed nor wanted.

Most importantly, we request that you, as an agency, do your due diligence. Hold a bilingual public hearings in Santa Teresa, with virtual access, and distribute documentation in Spanish and English to ensure the public can respond to the department's analysis. Project Jupiter works against the state's climate goals, further contributing to overall air pollution and harming the health of New Mexicans statewide.

At Los Jardines, we supported Bernalillo County's Health, Equity, and Environmental Impacts Regulation because of unregulated emissions harming working communities of color across Albuquerque, specifically Mountainview and the South Valley.

At the moment, the state does not have proper air quality regulations or departmental capacity to ensure oversight and enforcement of our air quality and the protection of our public health, as your department has stated time and time again. Granted permits for the YGI microgrid application will not only be a reckless decision, but a costly one for our communities. Deny YGI's microgrid air quality permits, hold bilingual hearings, ensure public engagement is intentional by granting an additional 60 day public review process, and protect our health and environment. Do not permit the sacrifice of our people and our lands.

For the past two ish years, I believe, we have been in a drought or near drought conditions. Within the last six months the Rio Grande has completely dried up. I know people keep saying, "oh, it does that. It'll come back later" but if this power plant gets approved, it won't. This power plant may not affect our water reserves directly, but it does affect our climate and climate affects our water, the amount of precipitation we get, the weather, migration patterns, mating patterns, and agriculture; all of which are extremely important for New Mexico.

For the past 60 years scientists have been warning the public of the climate crisis, and as our nations continue to become more and more industrialized, it's gotten worse. We have about 3 years to start reversing climate change before the effects are even more detrimental than they already are. If this power plant gets built, 10 million tons of green house gasses will be produced every year. Not only is this harrowing for the environment it is also harrowing for the surrounding communities. For instance, the elementary school and high school that are located within 5 miles of the project site. The children and teenagers in these schools are vulnerable to the health risks of said green house gasses, (Nitrogen Oxides, Carbon Monoxide etc.) as well as the residents who live near the site. It will impact these residents horribly and will leave them with a number of health conditions. Not to mention the injustice you will enact on them because of it.

If this plant gets approved, where will the toxic waste from the fuel cells go? In our communities or at least not far from them. New Mexico has beautiful agriculture, scenery and wildlife. If we allow this power plant to happen, all of New Mexico's beauty will be sullied by the waste that they plan to dispose of (most likely) in our communities.

If NMED allows this power plant to be built, their entire message and reason for existing is for nothing. Their mission is "to protect and restore the environment and to foster a healthy and prosperous New Mexico for present and future generations". If they allow Project Jupiter to be built, not only are they hypocrites, but they are enacting an injustice to all New Mexico communities and the land itself.

I love this state and the city I live in, and seeing someone trying to propose a project that will do more harm than good to the entire state is angering. We have so many issues that need to be fixed within it and instead they're promoting something that will have irrevocable consequences and add more damage to the already existing issues. If NMED and our state's government truly cares about our land and its people, please reject the proposal. We do not need this, nor do we want it.

* Unprecedented, Unproven Scale: YGI proposes using 2,275 Bloom Energy Solid Oxide Fuel Cells (SOFC). Though several projects have been announced with much fanfare, the largest operating Bloom installation is a 40 MW facility - 60 times smaller than what is proposed here. Scaling this technology to a mega-utility application remains entirely unproven.

* Suspect Estimates & Inadequate Testing: The emissions data provided is based on testing of a single, 65 kW unit four times for four hours. Extrapolating data from a unit 37,876 times smaller than the proposed plant capacity - and adjusting it with an arbitrary 15% safety margin - fails to provide credible empirical evidence. The emissions data provided by the company cannot be trusted.

* Enforcement Impossibility: The design routes 2,275 individual cells through separate stacks with no add-on pollution control mechanisms or integrated continuous monitoring for particulate matter, VOCs, or shifting CO2 intensity. NMED cannot practically enforce compliance under 20.2.72.210 NMAC across thousands of individual, degrading units.

* Severe Public Health & Environmental Impacts: The microgrid will emit 161.2 tons/year of CO and 124 tons/year of VOCs near existing EPA non-attainment zones. It will generate a thermal plume and a "heat island" effect, raising downwind temperatures by up to 3.6°F in a sweltering desert climate, threatening vulnerable populations.

Furthermore, concentrating 10M metric tons of climate-warming CO2 into 275 acres - exceeding the combined emissions of Albuquerque, Santa Fe, and Las Cruces - creates localized health risks. Emerging 2025–2026 research links elevated CO2 levels to permanent changes in human blood chemistry, oxidative stress, and cognitive decline. Because CO2 sensitivity exists on a normal spectrum, even minor baseline increases can induce anxiety and panic attacks in sensitive individuals.

Viable alternatives exist. The June 2025 Lazard Levelized Cost of Energy Report confirms that renewables are the lowest-cost resources to deploy and tech leaders are already powering massive data centers using firm solar-wind-battery configurations.

YGI must not be allowed to greenwash a fossil-fueled plant that erases New Mexico's climate progress. NMED must reject this permit, or at the very least schedule a formal public hearing to investigate these severe community impacts.
