I strongly oppose the air quality permits for Project Jupiter. While I believe data centers can be built in an environmentally responsible and sustainable manner, the current plans for Project Jupiter fall far short of that standard.

Las Cruces has ...↓enjoyed good air quality for generations. Project Jupiter's own permit filings acknowledge that its planned gas power generation would severely impact that air quality. By the developers' own estimates, the two microgrid power plants would emit more greenhouse gas pollution than Albuquerque and Las Cruces, New Mexico's two largest cities, combined.

I do not believe the promise of a modest number of jobs justifies this level of environmental harm. The tradeoff being offered, a relatively small number of long term jobs against a massive, permanent increase in regional air pollution is not a fair or acceptable one for the community that will have to breathe this air for generations to come. Nevermind the increase in water consumption and energy prices for residents as a result of Project Jupiter.

I also want to raise a serious concern about the integrity of this public comment process. I read dozens of comments submitted in support of Project Jupiter which were identical, submitted at the exact same time, under different names. It is clear these are not genuine letters of support from real people.

In addition, multiple news outlets have reported instances of individual's comments on the project being completely altered by Project Jupiter canvassers. Canvassers reportedly approached people in public places, collected their email addresses, and then submitted comments in their names in support of the project without consent. Multiple residents in Las Cruces, Albuquerque, and Rio Rancho have since said they discovered their names attached to pro Project Jupiter comments they did not write and do not agree with. This pattern, in addition to the dozens of comments with identical wording submitted under different names at the same time is not evidence of genuine grassroots support. I urge NMED to discard clearly manipulated submissions and to investigate this blatantly unethical campaign, as it appears designed to manufacture the appearance of public support that does not actually exist.

This project has the potential to affect far more than its immediate location. Air pollution does not stop at county or state boundaries. Emissions...↓ from this facility have the potential to impact residents throughout the Paso del Norte region, including the communities of Doña Ana County, Las Cruces, El Paso, Texas, and Ciudad Juárez, Chihuahua. The New Mexico Environment Department should carefully evaluate cumulative regional air quality impacts, not just the impacts immediately surrounding the facility.
This region already faces significant environmental challenges, including high temperatures, ozone episodes, dust, and wildfire smoke. Adding another major source of emissions risks further degrading air quality for hundreds of thousands of people who live, work, and attend school in this shared airshed. The permitting process should account for cumulative impacts on public health, particularly for children, older adults, and people with respiratory and cardiovascular conditions.
I am also deeply concerned about water resources. Southern New Mexico and the surrounding region face chronic water scarcity and prolonged drought. The region is out of water and water table is residing to the south. This project, which has zero benefit to locals will consume the regions water only to make someone else money who does not live or contribute to the community. Decisions about projects of this scale should reflect the long-term sustainability of the region's limited water supply. I am so ashamed of our county representatives.
Finally, I am concerned about the transparency of this project. A proposal with potentially significant regional environmental consequences should be subject to broad public awareness and meaningful public participation. Many residents who could be affected may not have been aware of the project until late in the permitting process or to this day. The public deserves an open, transparent process that allows adequate time to review technical documents, understand potential impacts, and provide informed comments before permits are issued.
Given the potential regional impacts on air quality, the serious concerns regarding scarce water resources, and the importance of a transparent public process, I respectfully request that the New Mexico Environment Department deny this permit unless it can clearly demonstrate that the project will protect public health, safeguard limited natural resources, and fully comply with all applicable environmental laws and regulations.
