I share many concerns with others. For one, through my work as a civil servant for the United States government I have seen first hand how drought has affected the southwestern states. It is a fact that these centers use a substantial amount of water at a rate in which it cannot be replaced. Other environmental concerns involve the amount of power used. The proposed "micro" grid has a 2,462 MW Capacity. For comparison, the El Paso Electric grid is about 2,900 megawatts (which services NM's second largest city, Las Cruces) and the entire PNM grid is about 2,700 megawatts. Each of those grids include a substantial amount of renewable energy sources and each of those grids has lower total greenhouse gas pollution than just Project Jupiter's proposed power plant. Additionally, Project Jupiter's power plant will release up to 10 million tons of climate-warming greenhouse gasses every year. This would make a mockery of NM's climate goals, and erase most of the climate progress we have made in the last two decades. This is more greenhouse gas pollution than New Mexico's three largest cities combined – Albuquerque, Las Cruces, and Santa Fe.

Additional concerns regarding Project Jupiter include the fact that Santa Teresa Elementary and High School are located within five miles of this project site. 96% of students at the high school are hispanic. There are also day care centers located within miles of this site. This is an environmental injustice to these children who are especially vulnerable to the health impacts of NOX, CO, and VOCs. This contamination is a result of the fuel cells that generate hazardous waste. Fuel cells filter out sulfur and other contaminants in the methane stream. These contaminants accumulate as hazardous waste in "desulf canisters." The power plant will be generating enormous amounts of hazardous waste. Jupiter claims that any pollution from opening and changing the filter media in the desulf canisters is exempt from air permitting regulations (because there is less than 1000 lbs/yr).

NMED's mission is "to protect and restore the environment and to foster a healthy and prosperous New Mexico for present and future generations." Granting these permit applications is a direct contradiction to that mission.

The project's proposed fuel cell powered grid is concerning for many reasons:
* It would still produce a high level of greenhouse gas and toxic pollutants.
* This technology generates toxic waste, and the process for handling this waste is still unclear.
* Fuel cell technology or a centralized waste system has never been tried at this scale.
* Surrounding communities' air will be severely impacted by this development.
I urge the NMED to reject YUCCA Yucca Growth Infrastructure, LLC's air permit application for the YGI Microgrid. I ask the department to please hold a bilingual public hearing near the Santa Teresa community, so that residents can learn about the risks associated with fuel cell technology.

Project Jupiter's estimated emissions are going to be 10 Million TONS of greenhouse gases and air pollution a year. New Mexico's three largest cities (ABQ, SF, LC) COMBINED only emit around 8 Million. Think about that for a second please. Not only would that make a laughingstock of our states progress toward our 2030 goal, it would SET US BACK years. Yes, yes, "jobs," "economic benefits," they say. Please explain to me... WTF is the point of jobs or economic boost if our air is UNBREATHABLE??? I'm just confused why anyone could every justify how this project is a good idea and worth it for the awful deal the developers are giving. In no world can you as the EIB justify approving these permits, no matter how you try.

Board, I would also like to emphasize that Data Centers across the country OVERPROMISE, UNDERDELIVER, and LIE about the so called job and economic benefits. Project Jupiter has already changed their job numbers over 6 times and their water usage numbers twice. Please explain to the public why on Earth we are trusting Billion dollar tech corporations who HAVE EVERYTHING TO GAIN by lying to us????? Because that makes all the sense in the world-- you would think as our local governments we would have some pride and dignity.

LOOK IT UP. Find the research and the studies. In another area, the data center deliver TWO PERCENT of the "promised jobs." Across the country, the infrastructure and community promises that were made, NEVER HAPPENED or were enforced. By approving these air permits you are essentially taking the money from these corporations and sacrificing our air, land, water and health.

Some last points to make are that the plan proposed for the Bloom Energy cells (not to mention Bloom is proven to be scandalous and shady and was a dying company before this life saving deal) has NEVER BEEN DONE AT THIS SCALE. We are guinea pigs. I can GUARANTEE that if this was proposed in YOUR background, next to YOUR children's schools, you would be voting no unanimously. Am I right?

P.S. Project Jupiter is out of compliance with their job reports- requirements for the IRB bonds. They have ALREADY BROKEN THEIR CONTRACT ON SEVERAL OCCASIONS. I ask again... WHAT!!???? They are also continuing construction without the LEGAL permits. Just tell us this is already set. Stop the the song and dance clown show. its insulting to your constituents- you have to feel some guilt, some inkling of guilt about how wrong this is.

It was found out that the County was not even all on the same page and some Commissioners were completely unaware of what was even going on, even being told different numbers. They basically got completely duped or paid off.

The cherry on top, are the FRAUDULENT bot and unauthorized comments that are flooding into this portal by the minute. Some of these names DO NOT EVEN EXIST. I ask again what you will do. Thanks for listening to my TedTalk that provides FACTUAL EVIDENCE for why this entire project is bogus, illegal, and totally untrustworthy.

Once again, I reiterate how this project will be DISASTROUS for DAC, as well as our state. It is not an investment or growth. It will RUIN us. Just so you all can make a quick buck.

I'm sure it's already a done deal, unfortunately. Shame, truly. I hope your children ask you one day why and how the state turned into what it did. Polluted, unlivable and with NO WATER. Oh, but we got 50 jobs for out of state people for 10 years :) Great Deal!! This project will not keep people here, it will make them MOVE AWAY and OUT of the state. We know you know it too.
