A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC. A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance. We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the statistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence. The public should be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably. The air quality permit application should be denied given Bloom Energy's history of illegal dumping hazardous waste. If the permit is not denied, a public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually. Approving this permit would be government-sponsored environmental racism as residents of Doña Ana County are already disproportionately impacted by environmental pollution. For years, Doña Ana County has been called a 'nonattainment' zone— this means our air quality does not meet federal government rules.

I am writing to express my strong opposition to Project Jupiter and respectfully urge the New Mexico Environment Department to thoroughly evaluate the environmental consequences of this proposal before issuing any permits or approvals. New Mexico is ...↓one of the most water-stressed states in the nation. We have endured years of drought, declining groundwater supplies, increasing temperatures, and growing competition for limited water resources. In a state where residents are constantly encouraged to conserve water, it is difficult to justify approving a project that could require millions of gallons of water annually to cool servers. Water is not an unlimited resource in New Mexico, and every large industrial user places additional strain on our communities, agriculture, wildlife, and future generations. Data centers are often promoted as clean because they do not produce visible smokestacks or heavy manufacturing waste. However, they carry a significant environmental footprint. These facilities require enormous amounts of electricity to operate around the clock, placing additional demand on an already stressed electrical grid. Unless that energy comes entirely from new renewable sources, increased demand can result in greater reliance on fossil fuel generation, leading to higher greenhouse gas emissions and poorer air quality. The environmental impacts also extend beyond water and electricity. Construction of a project of this scale requires substantial land disturbance, the removal of vegetation, increased stormwater runoff, habitat fragmentation, and significant construction traffic. Once operational, additional roads, transmission infrastructure, and utility expansions may be required, creating long-term environmental impacts that deserve careful consideration. I am also concerned about the cumulative effects of approving large industrial developments without fully considering what future expansion may look like.
If one data center is approved, it may encourage additional facilities to locate nearby, multiplying the demand on our limited water and energy resources. The Department should evaluate not only the immediate impacts of Project Jupiter but also the long-term cumulative impacts that could result from similar developments. While I recognize the importance of economic development and technological investment, those benefits should not outweigh the responsibility to protect New Mexico's natural resources. Economic growth should be sustainable and should not come at the expense of our water supply or environmental health. Any jobs created by the project should be weighed against the long-term costs borne by residents if groundwater levels decline, utility demands increase, or environmental degradation occurs. I respectfully request that the New Mexico Environment Department require a comprehensive environmental review that includes: A complete accounting of the project's anticipated annual water consumption. Identification of the water source and an analysis of potential impacts on local aquifers and existing water users. An assessment of projected energy demand and associated greenhouse gas emissions. Evaluation of impacts to wildlife habitat, vegetation, and nearby communities. Consideration of alternative cooling technologies that significantly reduce water consumption. A thorough analysis of cumulative environmental impacts if additional data centers are developed in the region. New Mexico's water is one of our most valuable and limited resources. Once depleted, it cannot easily be replaced. I urge the Department to place the long-term health of our environment and communities ahead of short-term economic interests and deny permits for Project Jupiter unless it can be clearly demonstrated that the project will not significantly impact our state's water resources or environmental quality.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How are we supposed to send our children to schools knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. The residents of New Mexico are not to be experimented on. There is nothing beneficial to our state or communities by the toxicity this will cause to our environment. This is not our way. Deny the air quality permit. The public should be given more time to review and comment on the air quality permit in order to evaluate the impacts to their communities and families. Given prior history Bloom Energy has already proven itself to be unreliable, untrustworthy, and irresponsible considering their history of illegal dumping of hazardous waste. Unacceptable in our own communities. People live here, for the love of God. Families send children to school here. Our environment is impacted and the people that live and work in the high desert deserve to have clean and healthy lives and air!! Assuming the permit is not denied a public hearing MUST be held in Santa Teresa (in English, Spanish, in person, and virtually)!! To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of. My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.
