The application relies on an unproven, unregulatable, and inadequately tested design:

* Unprecedented, Unproven Scale: YGI proposes using 2,275 Bloom Energy Solid Oxide Fuel Cells (SOFC). Though several projects have been announced with much fanfare, the largest operating Bloom installation is a 40 MW facility - 60 times smaller than what is proposed here. Scaling this technology to a mega-utility application remains entirely unproven.

* Suspect Estimates & Inadequate Testing: The emissions data provided is based on testing of a single, 65 kW unit four times for four hours. Extrapolating data from a unit 37,876 times smaller than the proposed plant capacity - and adjusting it with an arbitrary 15% safety margin - fails to provide credible empirical evidence. The emissions data provided by the company cannot be trusted.

* Enforcement Impossibility: The design routes 2,275 individual cells through separate stacks with no add-on pollution control mechanisms or integrated continuous monitoring for particulate matter, VOCs, or shifting CO2 intensity. NMED cannot practically enforce compliance under 20.2.72.210 NMAC across thousands of individual, degrading units.

* Severe Public Health & Environmental Impacts: The microgrid will emit 161.2 tons/year of CO and 124 tons/year of VOCs near existing EPA non-attainment zones. It will generate a thermal plume and a "heat island" effect, raising downwind temperatures by up to 3.6°F in a sweltering desert climate, threatening vulnerable populations.

Furthermore, concentrating 10M metric tons of climate-warming CO2 into 275 acres - exceeding the combined emissions of Albuquerque, Santa Fe, and Las Cruces - creates localized health risks. Emerging 2025–2026 research links elevated CO2 levels to permanent changes in human blood chemistry, oxidative stress, and cognitive decline. Because CO2 sensitivity exists on a normal spectrum, even minor baseline increases can induce anxiety and panic attacks in sensitive individuals.

Viable alternatives exist. The June 2025 Lazard Levelized Cost of Energy Report confirms that renewables are the lowest-cost resources to deploy and tech leaders are already powering massive data centers using firm solar-wind-battery configurations.

YGI must not be allowed to greenwash a fossil-fueled plant that erases New Mexico's climate progress. NMED must reject this permit, or at the very least schedule a formal public hearing to investigate these severe community impacts.

In fact, worldwide, Bloom Energy has developed 1.4 GW of fuel cell technology across more than a thousand locations, yet Yucca Growth Infrastructure is asking for nearly double that (2.46 GW of fuel cells) at a singular location. The largest fuel cell plant in the entire world is more than 30 times smaller than the fuel cell plant under consideration in Santa Teresa. There is absolutely no way to know, with certainty, what the actual pollution levels will be given the tremendous size differential, and thus gap in data, between operational fuel cell plants and this theoretical plant proposed by Yucca Growth Infrastructure. Betting the livability of our county on this unpredictable and unproven plan would be a total capitulation and betrayal of your so-called values: "protects the public health of New Mexicans...by preventing the deterioration of air quality;" "protect and restore the environment...foster a healthy NM for present and future generations"

Though approximations of annual air pollution were provided, the testing used an extremely weak methodology leaving us, ultimately, with pseudoscientific guesses that have large margins of error. Estimated pollution levels for this gas-powered fuel cell plant are based on only three 4-hour pollution tests from a very small unit (only 65 kW). This is a far cry from thousands of sweltering fuel cells operating 24/7 at maximum output in close proximity, all in the scorching heat of our open desert. The lack of rigorous testing at even this small of a scale is lazy and very concerning, especially given that the gas power plant Yucca Growth Infrastructure wants to build is 37,000 times bigger than this unit.

A 15% "safety margin" was added to the numbers provided by the applicant. Safety margins are not usually added if a company is confident in the accuracy of their pollution estimates. Even small variations from this superficial test will result in massively different levels of pollution and given that the plant will be 37,000 bigger than the testing unit, a 15% safety margin is completely insufficient–it could work as a margin for a single unit, but not the entire plant. If a unit has a 0.01% chance of failing (sounds promising right?), the odds of 37,000 of those units working perfectly at the same time is 2.47% (pathetically low feasibility). That means there is a 97.53% chance that the plant will experience at least one failure. What will the exact level of redundancy be? Will more fuel cells be rubberstamped or pollution levels overlooked in five years or less due to age-related inefficiencies?

What about cases of catastrophic failure? Are we approving those deadly incidents of pollution in advance without any real data informing us of the risks at this scale? Highly flammable hydrogen under high pressure only needs a microscopic crack to leak out, ignite, explode, and level entire neighborhoods and schools while sending shockwaves into nearby counties. Assuming this risk, an act of gross negligence, at a scale that has never even remotely been demonstrated in practice would be unbelievably careless. These permits must be denied outright. If further deliberation is desired, a public hearing in Santa Teresa is non-negotiable."

As a life long resident of NM, Dona Ana County, I have seen this town grow and evolve into what it is now. And as someone who as grown up along the Rio. I have family members who had cancers due to exposure to chemicals from poor structured facilities and spaces where they would otherwise have not gotten cancer from. And especially in Santa Teresa where they are already facing health problems due to negligence of contaminated water, and poor handling of waste. Not only will this data center harm our future but destroy it.

New Mexico Environment Department's (NMED) mission is "to protect and restore the environment and to foster a healthy and prosperous NM for present and future generations."

NMED's Air Quality Bureau "protects the public health of New Mexicans and the natural beauty of the state by preventing the deterioration of air quality."

Do your job and protect the environment from harmful data centers. I would not want to live in a community that has no Rio, no clean air or water, and everyone sick with cancer, children born with deformities and weak immune systems. People of Santa Teresa and Dona Ana County deserve better. Especially with already unresolved water contamination and pollution.

We the people of Dona Ana County and Santa Teresa demand that:

Be given an additional 60 days to review and comment on the air quality permit so community members can participate equitably.

The air quality permit application should be denied given Bloom Energy's history of illegal dumping hazardous waste.

If the permit is not denied, a public hearing needs to be held in Santa Teresa, in both English and Spanish, with an option to participate virtually.

Approving this permit would be government-sponsored environmental racism as residents of Doña Ana County are already disproportionately impacted by environmental pollution.

For years, Doña Ana County has been called a 'nonattainment' zone— this means our air quality does not meet federal government rules.

BIPOC and low income communities often suffer the consequences more frequently from climate change induced disasters. The metro area there is currently 16th worst in the nation for ozone pollution and has received a failing grade on this air quality standard every single year since 2000. People are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities.
The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How are people supposed to send their kids to school knowing what they are breathing in? Or elders traveling? Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits. There is no sustainable way of extraction."

I need to add an important story of the town of Picher Oklahoma. Once a booming mining town that was a major export for lead and zinc and helped supply the U.S army in WWII. The area is now a complete ghost town. It was declared a superfund site by the EPA while citizen STILL lived there. Overtime the huge piles of chat left outside the mines blew lead and zinc dust into citizen's homes and contaminated their waters. In the 90s and 2000s, 40% of children tested positive for lead poisoning. The final straw for eviction was the 300 miles of abandoned hollowed out mines that caused great risk of sink holes that could swallow the entire town at any moment. This story while devastating serves as a warning for what happens when we extract and extract with no regard for the consequences on the environment and our people. Don't let New Mexico become the next Picher Oklahoma. AI data centers will only extract the community's water."

The administrative maneuvers used by the Doña Ana Board of County Commissioners and corporate actors to advance this project represent a structural failure of transparent governance and local democratic representation.

1. Violation of Democratic Process and Lack of TransparencyOur public voices have been systematically bypassed. The Doña Ana County Board of Commissioners went into a closed, executive session during pivotal contract and tax incentive deliberations for this project. This clear disregard for the public has forced the New Mexico Foundation for Open Government (FOG) to file formal transparency lawsuits against the county over Open Meetings Act violations. Turning a promised public town hall meeting into a highly controlled corporate open house is not community representation—it is a closed-door corporate favor.

2. Misrepresented Public SupportThe claims of sweeping local approval for this project are foundationally compromised. Investigations have revealed that project canvassers approached residents in Las Cruces at gas stations and grocery stores, only to later use those names without permission on falsified support letters sent directly to state environment officials. We will not allow our names or our communities to be hijacked to rubber-stamp environmental degradation.

3. Severe Regional Environmental and Public Health ImpactsThe physical threats to our high-desert home are severe. The massive scale of Project Jupiter threatens our regional water table and power grid stability. Despite recent attempts to pivot to a Bloom Energy fuel cell microgrid design, serious questions remain regarding the massive natural gas or carbon-intensive hydrogen footprints required to power this layout. Bypassing independent, neutral environmental impact reviews exposes Doña Ana County residents to hazardous particulate matter emissions and severe long-term degradation of local air quality.

Conclusion

For decades, the authority of the "administrative pen" has been used to ignore ballot outcomes, block community opposition, and keep Southern New Mexico at an environmental disadvantage. I stand with the growing coalition of local residents and state legislators demanding an immediate halt to all zoning and air permit advancements. We demand a full, independent, third-party environmental review before our finite natural resources are permanently signed away.
