Members of the Environmental Improvement Board,

New Mexico has an immense opportunity before it. Project Jupiter has the potential to unlock new long-term investments, create jobs, and drive the state's economy to new heights. With that in mind, I write to express my support for the air quality permit applications for Project Jupiter.

Our state is in a race to attract talent, jobs, and investment. Artificial intelligence is the new frontier and has the potential to revolutionize every aspect of our lives. It is crucial that New Mexico play a leading role in this transformation, and we have an opportunity before us to become as regional, if not national hub, for the industry. With 4,000 construction jobs, and more than 1,500 permanent full-time jobs at all skill and education levels, with high paying salaries that will support strong middle-class families, it is an opportunity to put money into the pockets of New Mexicans with quality long-lasting jobs.

Project Jupiter is more than a jobs engine; this project will bring significant investment in the public institutions we all share. Tax revenue generated by this project will improve roads, support law enforcement, provide needed public services to support growth, and will go directly to the local school systems. All while direct investment in higher education and trade schools will ensure were preparing the next generation of technicians, mechanics, robotic engineers, hydraulic, and IT professionals alongside the AI safety researchers, infrastructure engineers, and agentic project managers. The opportunity for not just the next generation of the New Mexico workforce, but generations after that, will all see the long-term investments of this project.

Progress often comes with trade-offs, but this project is closely aligned and in compliance with the New Mexico Clean Energy Transition Act, which should provide a great deal of reassurance. Furthermore, the usage of on-site generation through a microgrid means this project will not provide additional strain on our utilities, protecting ratepayers while supporting regional resiliency. While the closed loop cooling system means that the water usage will be limited to that of a typical office building.

Project Jupiter represents a generational opportunity to push New Mexico to new heights. I urge the Environmental Improvement Board to approve these air quality permits.

My research invo...↓lved soot abatement for brick manufacturing and uranium abatement to produce potable water from uranium contaminated sources.

The data provided in this application comes from a test unit that was rated at 65 megawatts and operating at 71 megawatts; in reality the chemical and physical characteristics of these fuel cells will be magnified to meet the 2,461 megawatts needed for the proposed project. To extrapolate findings from this data to Project Jupiter is statistically questionable.

At larger scales, this project may perform much differently, ESPECIALLY because of the myriad of chemicals involved in this process.For example, temperature will effect many aspects of the project. Temperature impacts the productivity of each chemical differently. For this particular case, NOx is a product of nitrogen and oxygen from the air reacting to produce NOx. This process is very temperature dependent.

For example, methane is 32 times more reactive/ toxic than carbon dioxide. Problems will arise if methane were to leak during transportation or through on-site processes.There will be leaks. As another related example, N2O is 273 times more reactive/toxic than carbon dioxide. These are temperature dependent toxicities; this is why these related species should be considered independently.

Stacking Bloom energy server units will lead to completely different NOx concentrations due to increases in temperature such as with a stacked configuration. Therefore there is not a linear relationship with respect to the number of Bloom energy server units. A collection of units as proposed by Project Jupiter will definitely have a different temperature effect on the NOx that is produced. There is a likelihood that this profile will be exponential and runs contrary to a one unit analysis.

The effect of temperature on NOx reactivity is not linear; it is more "exponential-like".For example, NO and NO2 have different chemistries so to combine their reactivity on a mass basis can be erroneous especially if the mass ratios are significantly different.

The baseline testing by Montrose and Blue Sky was on a new unit, in the real world everything deteriorates and the situation will worsen over time. These different scenarios cannot be extrapolated and compared to initial readings from a new unit. The duration of a new unit is ephemeral to units that run non-stop.

This project needs attention from many dimensions, including water, soil and other aspects of community impact. Air quality considerations are in front of you and I ask that this permit not be granted until the entirety of impacts are fully studied and fall within accepted protocols and measurements.

During the last comment period, thousand...↓s of comments were submitting requesting to reject the air quality permits for Project Jupiter, now Project Jupiter is resubmitting with new fuel cell technology. Oracle and Open AI know how unpopular data centers are and realize that people around the nation are not going to stand for air pollution, water waste, and noise pollution. Project Jupiter has now dumped thousands and probably millions of dollars on propaganda to try and gain "support" for this disaster. They have PAID canvassers that walk around Albuquerque and Las Cruces to get signatures. And pay locals to promote Project Jupiter. There have been first hand reports of pedestrians OPPOSING Project Jupiter, and the canvassers will submit their name and email in support despite people verbalizing oppostion. NMED, please be wary of these many signatures in support of this Project, they have PAID for artificial support. There are even instances of canvassers trying to get signatures from the homeless populations in Albuquerque and Las Cruces. Project Jupiter is MANUFACTURING CONSENT through these paid canvassers, both on the ground and through social media. This is dangerous for the representation of public opinion and is highly unethical and questionable. If Project Jupiter is willing to use money and questionable tactics to push their data center and air quality permits forward, what other boundaries are they willing to cross? Oracle and Open AI behind Prohect Jupiter have the funds to pay for fake support, but this shouldn't mean that they can be approved to pollute our air, water, and land and push these boundaries further. We do not want air polluted with 10 million tons of carbon dioxide, especially next to a school. We want development for jobs, but not temporary construction jobs that go mainly to out of state residents. New Mexico is better than this. Santa Fe county has passed a moratorium on data centers. Will New Mexico allow the "Not in My Backyard" attitude to deny data centers in the more white and more wealthy counties and allow the exploitation of rural and predominantly nonwhite counties? NMED, we can decide to be better. PLEASE deny this permit. Approving this permit will allow not only the degradation of this beautiful state, but set a precedent for allowing air pollution and water wasting and extraction in water poor areas that are predominantly rural. If you haven't yet, look at the stories of communities impacted by large scale data centers, such as those in Loudoun County Virginia. Property values plummeting, constant noise pollution harming the health of residents, lies sold to county representatives.This project is not only a danger to New Mexicans, but all of the US. We are sitting PAST the tipping point of irreversible climatic change. New Mexico has seen UNPRECEDENTED fires earlier in the season that last into the winter. This is a direct result of unfettered carbon emissions. For what? What will this project provide? No sufficient long term jobs. No water to drink. No land for biodiversity. I am submitting this comment to share my strong opposition to the Yucca Growth Infrastructure, LLC-YGI Microgrid Air Quality Construction Permit Application. Please deny this application for the following reasons:

*YGI's application should be deni...↓ed by NMED because YGI failed to include all relevant information about Bloom Energy's problematic history. A report provided by Hindenburg Research has indicated the nature of the Bloom Energy company and its systems in other states which have higher emissions than they initially indicated [1]. This report was used in a court case (Jacob v. Bloom Energy Corporation) in Delaware where a shareholder of the Bloom Energy company was demanding an inspection of Bloom's books and records following the analysis of the Hindenburg report on the company [2]. In this case the court concluded granting Jacob limited inspection rights as Bloom's Form 8-K form rebuttal to the Hindenburg report as the form stated that there was an accounting error, giving some credibility to Jacob's concerns on the company's financial reporting [2]. Additionally, the EPA probed and fined the company over its handling of potentially hazardous waste from their solid fuel cells in Delaware which ran on natural gas in 2020 [3]. In fact, the company has a trend of downplaying the hazardous waste, including this year [3].

*Bloom Energy's Fuel Cells are not clean energy – no matter what YGI says. These fuel cells generate significant NOX, CO, and VOCs, all of which contribute to negative health impacts, as well as hazardous solid waste that cannot be ignored by NMED. The amount of greenhouse gases that would be produced is still above the emissions of New Mexico's biggest cities combined despite the fact that the fuel cells will emit about 2 million tons less in emissions than the original gas turbines at about 13 million, according to Bloom Energy's own Doña Ana County website [4]. This does not match the state's push for green and renewable energy as stated by the Energy Transition Act, which has "...set a statewide renewable energy standard of 50 percent by 2030 for New Mexico investor-owned utilities and rural electric cooperatives" [5]. Even the Office for Renewable Energy has a track record for renewable energy as touted by the Office's own state website [6]. However, this project's fuel source is the opposite of what the state's own legislation has set for moving away from nonrenewable and CO2 emitting energy sources. The natural gas powered, fuel cell micro-grid as proposed is almost a completed contrast to other energy projects such as the SunZia and the Iberdrola "El Cabo" projects [6].

*Permitting any microgrid facility will result in a clear example of environmental racism and NMED is required to ensure no group of people bears a disproportionate share of negative environmental consequences [7, 8]. This is especially important because Doña Ana County residents already bear the disproportionate burden of environmental pollution compared to the rest of New Mexico.

*NMED should give the public 60 days of additional time to review and comment on the Application to ensure everyone can meaningfully comment and participate.

Above all, the lack of information including the energy source the fuel cells use to residents in the city where the center will be located and nearby cities is not appreciated and should be taken into account when reviewing the application.
The manner in which information has been given has been seemingly muddy for a more popular result. For one, the manner of information about the project and its power sources lacks clarification for the general public, beyond just media coverage. For example, there is very little information about how the fuel cells are powered. When looking up the fuel cells used by the company, three options are talked about: natural gas, biogas, and hydrogen. But the exact energy type used for the Doña Ana County project's fuel cells has be limited. Few sources actually mention the fuel source, with the information difficult to find. It is not mentioned clearly to the public at all, and the Bloom Energy website mentioned it only under a Q&A about pollutant emittants [4].
There has been promotional material used for the project and the use of fuel cells which have been touting that the fuel cells are clean energy when it is not. Even the Bloom Energy website touts that it is cleaner, but only in air pollutants and not emissions despite the way the project likes to make it out to be clean energy [4]. This specific project for Doña Ana County has stated that the fuel cells will be powered with natural gas, which is in fact not a clean energy source [4]. If the project truly wanted to use clean energy, they would have used solar fuel cells, a different energy source that for the fuel cells such as hydrogen which is cleaner, or a combination of green energy sources. The fact that stating the project is using fuel cells and not specifically mentioning that they are natural gas powered is misleading in nature. Most people hearing the phrase 'fuel cells' will likely correlate it to solar powered fuel cells and the lack of clarification is used to generate a more positive perspective of the project's use of fuel cells to residents who have been pushing back on the project's water usage and emissions rates.
The greenwashing and misleading nature by Bloom Energy should not, and is not, acceptable to the county's and state's constituents which is why I believe that the application should be denied.

I have heard from family and friends in Valencia Park about their water pressure going down. I have heard from my grandparents down in Anapra that their neighbor's house burnt down, and the lack of proper water pressure caused a slower reaction from the fire department. I have been told my whole life living in Santa Teresa that our tap water is so subpar that we cannot drink from it. I was at home when the great Arsenic and oil issue of 2024 occured. This is not a one time occurence. Our drinking water has been contaminated since forever, and bringing a big data center will not help. Our lack of proper water pressure will only get worse; water contaminants will only get higher; the price of buying potable water will increase, limiting lower income families such as my own on how much water we can use. Water is a human right, not a privilege. We as citizens of Sunland Park and Santa Teresa deserve to be treated as humans. We deserve to stay in our homes, drink clean water, and not be pushed out by big companies only seeking revenue and land. This comment, however, seeks the NMED to look into air permits. This, too is an issue I am tired of seeing. We live in a desert where haboobs, sand storms, and metropolitan pollution takes over. We do not need another issue added to this. I urge the NMED to reject this air permit and realize that the citizens of this city do not want this data center. Listen to us, listen to everyone, and listen to nature. All of us seek safety, security, and health.

The project's proposed fuel cell powered grid is concerning for many reasons:
* It would still produce a high level of greenhouse gas and toxic pollutants.
* This technology generates toxic waste, and the process for handling this waste is still unclear.
* Fuel cell technology or a centralized waste system has never been tried at this scale.
* Surrounding communities' air will be severely impacted by this development.
I urge the NMED to reject YUCCA Yucca Growth Infrastructure, LLC's air permit application for the YGI Microgrid. I ask the department to please hold a bilingual public hearing near the Santa Teresa community, so that residents can learn about the risks associated with fuel cell technology.

The more research I do, the more concern...↓s I have, and I do not have time to write out all of this before the deadline. The short version, though, is that I am opposed to the approval of these air permits on both an individual level and on the level of our community. One household member has chronic illness and is immune compromised; an increase in pollution in our area will only make life harder for us. Similarly, one of our young children has asthma, and declining air quality will likely exacerbate this condition. On the level of our community, we live in a hot, dry climate and our region is very poor. There seems to be a risk that the proposed microgrid power plant could create an increase in ambient temperatures in the surrounding area due to waste heat, and I would ask that the applicants be required to analyze this impact if they have not. Many people in the vicinity of the proposed power plant are likely to already be without air conditioning; any increase in heat will cause increased hardship. On top of this, the facility's enormous carbon emissions would worsen the very heat and smog our region already struggles with during the summer.
I have concerns that the microgrid power plant plan appears to allow these companies, which seem to have considerable financial resources, to sidestep legal burdens that would require them to move toward renewable energy sources in a timely manner. According to analysis from New Energy Economy and others, this single private gas plant would emit roughly 10 million tons of CO2 per year, about three times the emissions of the entire Southern New Mexico and West Texas power grid, and more than the cities of Las Cruces, Santa Fe, and Albuquerque combined. That grid serves half a million homes and businesses; this plant would serve a couple of out-of-state corporations. It would seem reasonable that the applicants explain why they cannot adhere to a more traditional or cleaner power generation solution that would place less of an environmental burden on our community. I do not think it is unreasonable to slow this process down and make sure due diligence is done to ensure that this project takes into consideration the well-being and health of the residents in our area. It should be possible for the applicants to meet their goals without adversely harming our community. As residents of New Mexico, we are depending on the NMED to stand up for our rights and protect us from unnecessary harm. Sincerely, Earl Cason Dona Ana County

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities. The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up. Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.

My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.
