I am writing to express my deep concerns and reservations regarding the proposed Advanced Clean Car II Rules. While I wholeheartedly support the state's commitment to environmental sust...↓ainability and applaud the initiative to reduce greenhouse gas emissions through the adoption of cleaner vehicles, I believe it is crucial to take into consideration the unique challenges faced by low-income New Mexicans, the absence of sustainable state and national subsidies, and the current lack of reliable electric charging infrastructure.

New Mexico is a state with its own distinct demographic and economic challenges that differentiate it from states like California. As we compare New Mexico to California, we must consider that New Mexico has a lower average income and a higher percentage of its population living below the poverty line. The proposed Advanced Clean Car II Rules, while noble in their intent, may inadvertently place a heavier financial burden on the citizens of New Mexico compared to those in more affluent states like California. We must strive for environmentally friendly policies that are economically equitable and considerate of the unique financial constraints faced by New Mexicans.

In order to make the transition to cleaner vehicles more accessible to the residents of our state, it is imperative that we develop and implement sustainable state and national subsidies. While states like California have robust financial incentives to promote clean vehicle adoption, New Mexico lacks a comprehensive plan for such subsidies. These incentives are essential to reduce the financial strain on low-income individuals and families who aspire to make environmentally responsible choices. I urge the board to prioritize the creation of these subsidies as part of the Advanced Clean Car II Rules.

Furthermore, the lack of reliable electric charging infrastructure in New Mexico poses a significant barrier to the widespread adoption of electric vehicles. Our state's unique geography, with vast rural areas and limited population centers, demands a well-planned and extensive network of charging stations. Without such infrastructure, the transition to clean vehicles remains impractical for many New Mexicans. I implore the board to work on a strategic plan to expand and improve the charging infrastructure across the state.

In conclusion, I urge the Environmental Improvement Board to consider these concerns in the context of New Mexico's demographic and economic realities. While I support the transition to cleaner vehicles for the benefit of our environment, it is vital that this transition is attainable for all residents, regardless of their income or location. I hope that we can work together to create a more environmentally sustainable future that is accessible to everyone in our unique state.

Thank you for your attention to these important issues, and I look forward to seeing a more equitable and sustainable approach to the Advanced Clean Car II Rules.

Confronting climate change and environmental degradation has never been more urgent." Under the leadership of Governor Michelle Lujan Grisham, the New Mexico Environment Department's proposed rules regarding Clean Cars and Trucks would directly address climate change and greatly reduce harm to the environment. These rules require that by 2032 82% of new passenger vehicles in New Mexico will be electric or plug in hybrids. Additionally stricter rules will limit emissions through new tailpipe laws for existing vehicles. These will be giant steps in ending our dependence on fossil fuels and in reducing the particles that poison our air and cause so many health problems.
The time to act is now. New Mexicans have all witnessed the effects of devastating wildfires and other extreme weather events here and across the globe in the past several years. Scientists are predicting an escalation of the intensity and frequency of such events if we do not take action to stop depending on fossil fuels. I want my grandson and his peers to have a bright and healthy future. Auto emissions are a major cause of asthma and other respiratory illnesses. In addition, recent studies in Europe have demonstrated that these emissions also contribute to the increase in autoimmune disorders. We must protect our children from climate catastrophes and from air pollution. And we must demand justice for indigenous, brown, black and low income New Mexicans who are even more vulnerable to these health risks.
The proposed transition to clean cars and trucks may seem overly ambitious to some but I believe the goals are achievable because most Americans are well aware of the devastating consequences of climate change. When the rules are enacted, car dealers in New Mexico will be able to acquire more electric vehicles and consumers will be able to visit local dealers and have numerous models to choose from. Satisfied customers will convince others that the savings on gasoline and maintenance of electric vehicles more than offsets the electric bills for charging the vehicles. And with federal and state rebates and tax credits, lower income New Mexicans will also be able to purchase reliable, energy efficient transportation.
I urge the members and commissioners to lead New Mexico to a future of clean energy and environmental justice. Thank you for accepting my comments.

I also serve as VP of the National Caucus of Environmental Legislators (NCEL), which does not advocate for specific laws or rules - but shares environmental data and policies with state legislators and state policy makers, such as yourselves. I helped NCEL hold a forum in Santa Fe just last month for legislators from five SW states to strategize on how to increase the transmission grid capacity.

Previous to becoming a New Mexican in 2021, I served nearly ten years in the Oregon Legislature. There, I served on the Energy, Environment, and Water Committee, as well as on the Health Care Committee, where I heard hours of testimony from experts and examined data about the impact of the transportation sector on greenhouse gasses, on the climate crisis, and on the health of our communities.

Because of my alarm at the environmental and health costs due to fossil fuel production, transmission, and emissions, I strongly supported the Clean Fuels legislation that Oregon passed in 2015. Since then, Oregon has gone on to support more clean energy bills.

Oregon's law requires that by January 1, 2026, 35% of a manufacturer's car be battery-electric, hydrogen-powered, or plug-in hybrid (PHEV). This percentage increases annually. By 2035, 100% of new passenger cars, SUVs, and light-duty pickup trucks must either be battery electric or plug-in hybrid electric vehicles.

To help achieve that goal, the Oregon Clean Vehicle Rebate Program offers a cash rebate for Oregon drivers who purchase or lease electric vehicles. Note that a cash rebate is far more helpful to lower income families than a tax credit that they may not be able to take advantage of, due to a low taxable income level.

Given I had to drive over an hour a day from my home to Oregon's state capitol, I also changed my personal consumer choices on vehicles. I purchased a Prius in 2008, which I replaced with a leased Nissan (EV) Leaf in 2016, and then a Tesla in 2018. While I appreciate the enormous energy and maintenance savings and convenience from my consumer choices, I am well aware that not every New Mexican family can currently afford to make this choice.

We need to do all in our power to enable all New Mexicans to benefit from the widespread adoption of EV vehicles in our state.

So today I want to speak about the auto business.

Will auto dealers have to change their business practices with EV's? Absolutely, because they'll see less money from their #1 profit center, car repairs, since EV's only need about half as much maintenance. But that's great news for consumers. And Tesla's large service centers on Nambe and Santa Ana Pueblo lands show that EV servicing will provide great jobs.
It is just a fact of life that as technology changes, businesses have to adapt to stay relevant. That's been true in photography, in telephones and televisions; just like it was true for horse-drawn carriages.

And now the shift to EV's is happening, and quickly. The EV sales data tracked by Argonne Labs shows that EV's are now 11% of all US car sales, up from 5% in 2020, thus increasing at over 50% per year. And the #1 best selling car in the world, of all kinds, is an all-electric SUV, the Tesla Model Y, outselling the #2 Toyota Corolla.
Auto manufacturers are now racing to convert their designs and future production to EV's, because EV's are better vehicles and consumers demand them. But perhaps more importantly to traditional automakers, the largest EV maker, Tesla, is stealing their top-end market share, and expanding explosively. If they don't respond to that competitive threat, they'll go out of business. So automakers will be making and delivering more EV's to dealers every year. We need these clean car rules to ensure that New Mexico dealers don't keep those EV's off their lots.

EV's are where the market is headed, now. And successful businesses, to quote Wayne Gretzky, "skate to where the puck will be". Because these are just better cars in nearly every way - cleaner, safer, quieter, quicker, cheaper and easier to fuel, with no tailpipe pollution.
Please support these clean car rules, to cut tailpipe pollution, improve our health, preserve our climate and ensure New Mexico is a leader in both generating and using clean energy. Thank you.

#1: In 2018, after long driving Toyota Pr...↓ius hybrids, I decided to reduce my carbon emissions while powering my car mostly with my new solar panels by moving to a PLUG IN hybrid. So I went to the Toyota dealer in Albuquerque , and explained "I'd like to buy a PRIUS PRIME". The sales person's response? He burst into laughter and then said: 'Now, why would you want to do THAT?"

Well, It turns out that there was no dealership in NM that could sell me the car. So I went online, found the exact car of my dreams, on sale in Chicago where I once lived, flew to Ohare, and took a cab to a local dealer, and drove my great new Prius Prime home to New Mexico.

# 2: Fast forward FIVE years. 2 months ago, in September , I returned to the same dealership, and again asked if I could see the latest model of the new and improved Prius Prime. That very week Toyota had launched an ad campaign questionably claiming" Toyota offers more low and zero emission vehicles combined than any other automaker" . BUT, In fact, the sales person told me, New Mexico dealerships rarely receive any of these cars. Instead, as a former Coloradan, he would be glad to fill me in on the best Colorado dealerships, where EV's and plug ins are plentiful and moving fast.

The 'moral' of these stories? while there are rumors being spread about how clean car regs will force people to buy gas cars out of state, I can tell you for certain that the reverse is already happening: those of us living in the second sunniest state in the country are STILL, right now, being forced out of state to buy cars that run on renewable energy. Changing these standards will help build badly needed clean car inventory in NM.

And Finally, While everyone here today understands that no major infrastructure change is easy or smooth, I appeal to you on behalf of the 13 year old middle school students I currently help educate about climate change:

The difficulties of making this energy transition (being discussed here today) ..are VERY SMALL compared with the dire consequences to New Mexico of failing to stop every single source of greenhouse gas emissions from our state. As one of the most climateANDwater vulnerable states in the US, we urgently must do everything we can protect ourselves and mitigate the climate warming that is heating and drying our landscapes.
Please, approve the clean car rules as soon as possible. Thank you

By  fully adopting the Rules through 2035...↓, the rules would reduce climate pollution by hundreds of millions of metric tons by 2050, about the same amount as the total pollution New Mexico produced in 2018, making these among the most effective climate policies New Mexico could adopt.
Right now, there are dozens of zero-emission medium- and heavy-duty truck models already available or coming to the market soon. However, automakers prioritize Clean Cars states for EV availability, so shoppers often have a hard time finding electric vehicles on New Mexico lots and often have to go out of state if they want an EV. These Rules will provide much more choice. And yes, of course you can keep your gas car for as long as you like, and buy a new one if you really want, even at the peak of the proposed requirements.
However, A recent analysis shows that New Mexicans could receive up to $44 billion in public health and climate benefits just from adopting Clean Cars II through 2035. Clean Cars and Trucks together would:
 Avoid 136 premature deaths by 2050 and prevent 72,000 respiratory incidents from breathing polluted air; Create nearly 1,000 additional jobs, many in well-paying positions in electrical-component manufacturing and construction; Save individual EV owners between $14,000 and $16,800 during the life of the vehicle, and deliver more than $30 billion in total savings for drivers through 2050.
Other cost benefits of electric cars and trucks:
 Federal $7,500 tax credits are available for selected new EVs and $4,000 credits for used cars. These will be transferable to dealers so they can be taken off your purchase price.
 New Mexico utilities now offer rebates of up to $2,500 for home EV chargers and installation. Often enough to cover the entire cost.
 Plug-in hybrids are included in the Clean Cars II standards. These cars use battery charge for the first 30 to 50 miles and then switch to gas. Most hybrid drivers rarely have to buy gas because their daily driving doesn't exceed 30 miles.
 Because EVs remain parked most of the time, they are a highly flexible resource. Charging vehicles when the grid is underutilized allows utilities to spread their fixed costs and puts downward pressure on rates, saving the average New Mexico household up to $24 on electricity annually..
 Electric vehicles are expected to reach upfront cost parity by model year 2027, when this rule is implemented, and already many EVs cost less upfront than gas cars, even without incentives. EVs benefit consumers on Day 1 in most cases. Low-income customers spend a larger portion of their income on fuel, so this will have disproportionate benefit for low-income customers.

Please adopt The Advanced Clean Cars and Advanced Clean Trucks Rules, and bring profound health, economic, and climate benefits to New Mexico as soon as possible.

Today, I'm here to support the proposed mandate for electric vehicles (EVs) in New Mexico, and acknowledge some concerns raised about this initiative.

New Mexico is at the forefront of an exciting transition. Our state's EV movement is just beginning, offering a unique opportunity to integrate innovative technologies for the benefit of all New Mexicans. The implementation of the Advanced Clean Cars and Trucks standards is a vital step in this journey. While some view EVs as a luxury only accessible to the wealthy, the landscape is rapidly evolving. Affordable models are emerging and the secondary market is growing, making EVs accessible to a wider demographic.

The economic argument for EVs is compelling. Electric vehicles offer significant savings in fuel and maintenance, debunking the misconception that they are prohibitively expensive. The stability of electricity prices compared to the volatile nature of gasoline costs further strengthens this argument. Additionally, federal tax credits available for EVs make them an even more attractive option for New Mexicans.

Federal and state investments are rapidly enhancing the EV charging infrastructure across New Mexico. Tech advancements in EVs are leading to longer ranges and faster charging times, increasing their practicality for everyday use. The wide-scale adoption of EVs also promises to reduce electricity rates for all, by encouraging charging during off-peak hours and making more efficient use of the grid.

The adoption of robust vehicle standards, such as those proposed, will not only benefit the environment and public health but also drive economic growth and job creation. By setting a clear direction for the automotive industry, these standards can stimulate investments and innovation in the clean transportation sector.

In closing, the adoption of the Advanced Clean Cars and Trucks standards is a crucial step towards a sustainable and equitable transportation future for New Mexico. While the transition to EVs presents challenges, these are outweighed by the long-term benefits of sustainable transportation, economic resilience, public health, and environmental protection. Thoughtful policies and continued technological advancements can ensure that the benefits of this transition are equitably distributed. We strongly support ACC II & ACT rule adoption in New Mexico.
