Short of stating the obvious, New Mexico is still mostly rural and its citizens drive long distances on a routine basis, and to be honest and frank a large portion of its citizens are not adept or willing to have to rough it on the road. Currently I ...↓see no less than five cars on the shoulder of I-25 ever time I drive to Albuquerque. Most of these cars the average person is unable to perform any remedial repair or troubleshooting on the spot. At least fuel gauges are able to be read easily and fuel stations are numerous and generally easy to find and refuel. Add to the problem of complexity of modern cars the shortage of recharge stations and the length of time to recharge will cause drivers to risk it and get to their destination without the stop. Leading to more stranded cars and drivers on the road side and increased safety risks to other motorists. Not to mention the increased fire hazard in an already fire-tendered state. The current state of electric automobiles is not to the level of confidence and reliability for anyone living in the rural areas. Let alone the trucks, which is the other subject at hand. Reduced payload, longer refueling/recharging stops doesn't not work with the farm and ranch operations. In the past the state has already made a concerted effort to diminish the role of agriculture by making them license as commercial vehicles instead of a farm plate. Diesel powered vehicles are still by far the most horsepower and economy for the cost of operation and production. The tasks of harvesting and moving livestock cannot be planned around recharging of batteries. Basic fact it takes longer to achieve a full charge than to drain it. That equates to much higher costs of down time where work is not getting done. This country is built on the capitalist ideal and with that these decisions should be by supply and demand and not forced upon us by government individuals who think they know best sitting in their house in the city that drive less than 20,000 miles in a year. You may possibly convince me to change my mind if you begin flying people around in electric powered jetliners. If it doesn't make sense to do that then how does it make sense for the working class or anyone who likes to take trips? Like to the sites of New Mexico. Think about it from our perspective and hopefully you can admit this is a bad move. If you want to be like the California coast and urban areas then go live there.

New Mexico can generate $3.3 billion in public health, environmental, and economic benefits and avoid more than 28,000 respiratory illnesses by 2050 by transitioning to zero-emission electric trucks, according to a recent study by the Union of Concerned Scientists.

In addition to the environmental and public health benefits, a report found that adopting the
Clean Truck standards can lead to:
Significant fuel and maintenance cost savings for trucking companies

Lower electric bills for all consumers
Attract over $1.4 billion in investments for in-state infrastructure. The supply of zero-emission trucks and buses along a prescribed timeline, more private investments will be attracted to New Mexico.

I am writing to express my strong support for Clean Cars and Trucks and Heavy Duty Omnibus standards to apply to the 2027 model year.

Nine other states have already embraced these standards. Cleaner cars and trucks are a critical tool in solving the urgent climate crisis, but they will also save New Mexicans billions of dollars by 2050 and prevent thousands of deaths and respiratory attacks. New Mexico-specific analyses have found that Clean Cars and Trucks would slash climate pollution by up to 139 million metric tons by 2050, the equivalent of the entire state's emissions in one year, making these standards among the most effective climate policies ever adopted in New Mexico.

They will also help New Mexico access millions in Inflation Reduction Act funding to boost EV infrastructure and make clean cars more accessible, affordable and convenient. In addition, a new study shows full adoption of Clean Cars alone would increase New Mexico economic activity by up to $44 billion and add nearly 1,000 jobs.

The New Mexico studies also show that Clean Cars and Trucks standards will literally save lives in New Mexico, preventing 158 premature deaths and more than 76,000 cases of respiratory illnesses by 2050. These standards will allow broader access to these money- and life-saving vehicles for all New Mexicans.

The state should seize the opportunity to adopt these standards together in 2023 to get cleaner trucks and cars on our roads sooner and bring New Mexico back in line with life-saving pollution standards. Thank you for your consideration.

I OPPOSE adoption of the ACCII EV Mandates in Albuquerque and New Mexico. My reasons are: (1) The EV mandate is unnecessary for good air quality in Albuquerque. Albuquerque already has a vehicle emissions inspection program which has worked very we...↓ll, and Albuquerque and Bernalillo County have been 100% attainment of all Federal Clean Air Act standards since 1996, thanks primarily to our vehicle inspection program. (2) By contrast the Los Angeles Basin in California has been a "non-attainment" area under Federal Clean Air Act standards since even before 1996, because of the unique problems of the L.A. Basin, specifically over 10-million people in the Basin and over 6-million motor vehicles in the Basin. This is why California has its own motor vehicle emission requirements. Because New Mexico does not have those California air quality problems, California vehicle emission requirements are not appropriate for New Mexico. (3) New Mexico and Albuquerque are economically poor compared with California, and the artificial scarcity in new internal combustion vehicles which will inevitably result from the ACCII EV Mandate and forced limits on sale of new ICE vehicles will drive prices on both new and used ICE vehicles through the roof (just as the shortage of vehicles did during the Covid lockdown, or more so), and this will especially hurt working families whose primary need is for a vehicle which meets their basic transportation needs with the most affordable upfront price possible. The artificial scarcity in new and used ICE vehicles which the EV Mandate will create will disproportionately hurt working families, because rich people will bid up the prices of the ICE vehicles which they want, or even go out of state to get what they want, while working families will find themselves without vehicles, with substandard vehicles, or with exorbitant car payments that will prevent spending on other necessities. I believe the ACCII rule is "PIE IN THE SKY" for rich people, and will have severe unintended consequences for working families, and does not satisfy a cost-benefit analysis considering that Albuquerque and Bernalillo County are already in 100% attainment of all Federal Clean Air standards with the vehicle inspection program we already have. Please do not impose this rule on us. Please let the market for EVs develop naturally in Albuquerque and New Mexico, not through an EV Mandate developed for California, a much different state. Please use good, clear and old-fashioned New Mexico thinking, and reject this ACCII EV Mandate. Please stick with what we already have, which is working fine today and will still be working fine tomorrow.

Advanced Clean Cars and Trucks
Thank you to the Members and Commissioners for this opportunity to lend my opinion regarding the Advanced Clean Cars and Trucks Rules.
My name is Kristin Graziano and I am a family physician from Arroyo Seco NM. I have ...↓lived and worked in northern New Mexico for the past 10 years, spending most of my career with the Indian Health Service on the Navajo and Jicarilla Apache reservations and most recently at a Federally Qualified Health Center in Questa.
On behalf of myself, my community, and my patients I am firmly in favor of adopting the strongest Clean Cars and Trucks rules possible.
As a doctor, I come to this issue from 2 avenues. The first is from a health and well-being perspective. The second is from a Health Equity perspective.
We have decades of research linking the toxic soup of air pollution to a multitude of medical issues including respiratory and cardiovascular problems, cancers, neuropsychiatric disorders, and poor pregnancy outcomes. And let us not forget that air pollution is directly linked to Premature Death. The Clean Cars and Trucks standards will prevent 158 premature deaths and more than 76,000 cases of respiratory illnesses by 2050, just by reducing particulate matter alone.
In addition to air pollution, tailpipe emissions contribute to greenhouse gases and climate change. Those of us on the frontlines of health care are seeing the detrimental health effects of climate change occurring right now. Heat related illness. Dangerous air quality due to wildfire smoke. Increased depression and anxiety. Adopting Clean Cars and Trucks will greatly decrease the greenhouse gases fueling climate change and lessen these negative health impacts.
These are my patients. I hear their stories and their frustrations from being ill because of their environment. I usher them through treatments. I order their oxygen. I write notes to excuse my pediatric patients from missing school again because of another asthma attack. I worry about my patients quality of life and the lifelong negative health consequences they may face because of the environment. I worry about my community not being able to play or exercise outdoors because of poor air quality.
Earlier, I mentioned Health Equity. We know communities of color and poorer neighborhoods are disproportionately affected by these health issues. I have spent my career in these communities. I can tell you that my patients are no less deserving, no less entitled, and no less worthy of having clean air and a healthy environment.
Transportation is New Mexico's 2nd largest source of climate and health-harming pollution. We have an opportunity to improve the health of New Mexicans. We have an opportunity to do the right thing by cleaning up the air the most for those who are impacted the most. We have an opportunity to curb climate-related health impacts that New Mexicans are facing now and are certain to increase.
I strongly urge you to seize this opportunity and adopt the strongest Clean Cars and Trucks Rules as quickly as possible.

Thank you for this opportunity to speak today in Strong Support of your adoption of 'Advanced Clean Car and Advanced Clean Trucks' standards proposal EIB 23–56, to bring...↓ profound Health, Money-saving, and Climate benefits by providing more opportunities for New Mexicans to choose electric and hybrid vehicles.

Adoption of 'Advanced Clean Car and Advanced Clean Trucks' standards would provide many more New Mexicans the opportunity to participate in improving our environment for all us, while saving themselves more than $1000 a year of their money, not spend on gasoline.

The Advanced Clean Car and Advanced Clean Trucks' standards proposal EIB 23–56 would require auto-makers to make more electric and plug-in hybrid vehicles available to New Mexicans, starting with 2027 model year, while protecting New Mexicans choice to drive their fossil fuel combustion engine vehicles.

These 'Advanced Clean Car and Advanced Clean Trucks' standards are needed to provide New Mexicans with the opportunity to save money, because currently, automakers prioritize providing these vehicles to states that have clean car standards.

This results in under-supply of clean vehicles to New Mexico, depriving most New Mexicans from the opportunity of saving on average more than $15,000 over the life of their clean vehicle, in their money not spent on gasoline, and combustion engine vehicle repairs.

I can personally attest to saving over $14,000 in money not spend on gasoline, which I have documented over the past 13 years that I have owned my hybrid vehicle. The original battery continues to work well, and routine maintenance has averaged less than $400 per year over the entire 13 years.

New Mexico's adoption of 'Advanced Clean Car and Advanced Clean Trucks' standards would provide additional savings benefits for New Mexicans, by providing them the opportunity to save up to $7500 in Federal tax credits, taken directly off the purchase price of a clean vehicle.

'Advanced Clean Car and Advanced Clean Trucks' standards would also reduce climate pollution into the air we all breathe in New Mexico, by millions of metric tons every year, making the adoption of 'Advanced Clean Car and Advanced Clean Trucks' standards among the most effective Climate policies that New Mexico could and should adopt.

I appreciate this opportunity to stand in Strong Support of New Mexico's adoption of 'Advanced Clean Car and Advanced Clean Trucks' standards, towards enabling my fellow New Mexicans to be a part of cleaning our air for better health, while providing themselves the opportunity to save thousands of dollars of their money.

I am a proud member of the Ho-Chunk Nation of Wisconsin, I am a daughter, a Tribal advocate, supporter of the proposed EV rules, and concerned and connected with what the potential of these EV rules will mean for the 23 Tribal Nations and Pueblos within the state of New Mexico. I think it is fitting that we are having these conversations and important rulemakings now— as we approach celebrating the second anniversary of the Bipartisan Infrastructure Law and Jobs Act, one of the most successful investments in climate infrastructure and domestic supply chains that our country has seen under the Biden administration. All with the goal of building a clean energy economy. And it's working, but this is not to necessarily draw all the light and attention to federal policymakers– but to state-level policymakers like you who sit on this board and actually have the ability to continue building on rules and legacies that slash costs on cleaner technologies such as EVs for every day New Mexicans. Already, New Mexico has been allocated $22 million to date to build out a network of EV chargers across the state through the BIL– with more to come. And I know what that means, more electricity usage within the state means a higher need for reliability to prevent outages and make the grid more resilient. Well, this is also being addressed by federal climate dollars with approximately $74 million allocated for clean energy updates to create that reliability.
Vote Solar is a non-profit dedicated to pushing state-level solar policy with a people-centered approach: and for me, this means working with Tribes and Pueblos in New Mexico and hearing their concerns and amplifying their visions for a energy independent future as equal partners with the state; naturally our work has extended to EVs, and for me Tribal EV initiatives as they lead to ultimately this idea of energy independence. Vote Solar has participated formally in several transportation electrification plans. And I do not speak on behalf of any Tribal Nation, but I do know that there is excitement from Tribal communities to be part of the EV transition. And it is exciting. Picture an inter-tribal EV charging network (like the one established in Minnesota by a coalition of Tribes, NGOs, and the state's utility Xcel Energy) and charging infrastructure wholly owned and managed by Tribes and Pueblos in the state, providing additional revenue to these communities, workforce development, tourism in rural areas.... Each tribal nation, connected by these future EV Pathways with casinos, restaurants, and retail offerings– all stimulated by these early rulemaking decisions. Before assuming that every Tribe and Pueblo will have fear and anxiety about EV rules and increased EV sales within the state, I would encourage you all to have conversations with these Tribal leaders for solutions. Tribal concerns will be different. Thinking ahead, I'm already preparing for how Tribes and Pueblos can connect with future transportation electrification plans between utilities and the PRC, and how they retain sovereignty in every step of the way (to clarify, Tribes and Pueblos do not need these rules to pursue EV adoption and rulemakings within their communities, but state collaboration is at times important in implementing these ideas across state and Tribal lands).
In closing, I urge the board to adopt these rules. It will position New Mexico to be ahead and in front of this evolving industry, and it will position collaborative networks between the state and Tribes and Pueblos. There's hope in these rules to address real climate issues; not anxiety or threats to existing vehicle owners in the state. It is all connected, solar energy, the clean energy transition, clean cars– and what a good day to be able to remind the board and the others listening in on the importance of Tribal perspectives in this decision making process and the future for EVs for Tribal communities as well. As an electric vehicle owner for over five years, my impression reading the editorial is that the editors were writing based somew...↓hat on fear and lack of personal experience, with perhaps a bit of influence from the oil and gas industry and the automobile dealers.

I'm writing as a citizen who is very concerned about climate change. I love my electric vehicle (EV), and I know it is helping create a future with a livable planet. So I'll never go back to an internal combustion engine (ICE) vehicle. Informed people know that we absolutely must transition away from ICE vehicles to EVs as an essential step to reduce greenhouse gases in time to preserve the future livability of the planet.

At Monday's hearing, a number of people remarked that it is difficult to purchase an EV in New Mexico. I agree. I had to go to Colorado to purchase mine back in 2018. By requiring dealers to have inventories of EVs, these rules will ensure that EVs are readily available for New Mexicans to purchase. And once people start to purchase them and influence their friends to purchase them, I predict that just like me, they'll never go back, reducing future demand for ICE vehicles. So the idea that there will be reduced inventory of ICE vehicles shouldn't have to be a problem—there should also be reduced demand.

Moreover, we really need for there to be fewer ICE vehicles on the roads, so if they do happen to cost more, as feared by the editorial board, that would create desirable market pressure for people to buy EVs. Additionally, a state requirement to have certain levels of EV inventory will incentivize the auto industry to produce and make available to dealerships the EV models that people want to buy, which would need to include lower-priced models.

The editorial hypothesizes that local auto dealers will lose sales of ICE vehicles to other states if we don't have sufficient inventory. That is speculative, though it could happen. But probably not to a great degree, given the fantastic features, attractiveness (so zippy!) and cost savings of the upcoming EVs. It could also happen that if dealerships have great inventories of popular EVs, out-of-staters who can't find those models in their states will come here to buy them.

One effect that will almost certainly happen over time is that dealerships will perform far less maintenance on cars that they sell. That's unavoidable, since EVs require very little maintenance. But keeping up an income stream for those who maintain ICE vehicles is not a good enough reason to slow-walk the necessary transition to EVs. The gradual reduction in demand for maintenance of ICE vehicles could be managed with natural attrition and a shift to maintenance of EVs.

The editors say, however, that EVs are too expensive for most New Mexicans. But even at the price I paid, I'm confident that, with purchase price included, I spend far less on transportation over the life of my car than the average driver, due to low maintenance and operational costs. Statistics back me up on that: EV owners save between $14,000 and $16,800 during the life of the vehicle. Moreover, the editors have assumed that the cost of an EV today will always be the same. That's unlikely. Prices on EVs are predicted to come way down in the near future. Moreover, tax credits will bring the price even farther down on qualifying models.

Additionally, when we think of the "cost" of driving an ICE vehicle, we need to take into account not just the sticker price, but also the staggering cost of the health problems they cause, the deaths, health emergencies, and chronic diseases from breathing ICE tailpipe emissions. EVs cut these costs to zero—a huge savings for all of us.

The editors also argue that EVs have limited range. I respond that I've taken my EV twice to Yosemite, California, and routinely travel back and forth from Albuquerque to Taos or Gallup, with no problem regarding range. They further say that places like Española have only one charging station. Yes, we certainly need to get more charging stations in all areas of our state (and available to apartment dwellers), but at the same time it should be clearly understood that most EV owners routinely charge at home, not at public charging stations. For example, in the five-plus years I've owned my EV I've charged at a public charger in my own city just twice, once to test it out and once because I failed to plan ahead. But even that was very cheap, compared to gasoline.

The editors also complain that, "Government mandates and tax rebates wouldn't be necessary if people actually wanted EVs. They'd sell themselves." They should have heard the enthusiasm of EV owners at the hearing and the press conference following Monday's noon meeting session! People tend to love them!

Furthermore, it seems to me that we as a society have, for example, encouraged water conservation and electricity conservation by offering rebates for water- and power-efficient appliances and fixtures. Rebates are a common way of achieving a necessary or desirable change. They are all the more needed to leverage a major change, such as moving to EV's, a technology unfamiliar to many people.

So I'm in favor of the proposed Advanced Clean Car and Trucks rules, which, contrary to the opinion expressed in the editorial, could be modified should that become necessary.

I currently volunteer as vice-chair of 350 Santa Fe, an organization dedicated to eliminating emissions of carbon into the environment.

I support this rule primarily because it's an essential step toward meeting our obligation to our children and future generations. To continue emitting carbon dioxide and methane into the atmosphere at the current rate will lead to increasingly severe and irreversible impacts on our lives and those of our descendants. Transportation emissions are a major reason that our country is the largest per capita source of greenhouse gas emissions. And New Mexicans profit enormously from fossil fuel production, making our responsibility all the greater.

Your proposed rules take an important step in the right direction. My wife and I have owned a Chevy Bolt for over three years now. It was not that much more expensive to buy than a gas-powered car, especially after we obtained our federal tax credit. Both those and new state tax credits are likely to be available when this rule takes effect, making these vehicles even more affordable for anyone needing to buy a car. The federal incentives will even apply to used EV's. And a rapid increase in the number and speed of charging stations is coming as well.

We have found that our maintenance costs have been almost non-existent, except for tires; and of course, we have never had to stop at a gas pump for this car. We instead installed a charger in our driveway, where our solar panels provide our car's fuel. The car also performs wonderfully.

Some opponents of this rule will argue that EV's cost more and should not be forced on us. But the costs of allowing New Mexico's climate to succumb to climate change will be greater still-- in drought, heat, agricultural losses, flora and fauna extinction, proliferation of invasive species, and declining property values, to name just a few. And every attempt to reduce emissions will have opponents claiming economic loss—"try something else," they tell us – for almost every proposed solution.

But the climate crisis is resulting from multiple sources of greenhouse gas emissions. It can only be resolved by addressing all of those sources. Your rule addresses the emission of greenhouse gases from transportation in New Mexico.

You are on the right road—please stay on it.
