Furthermore, the impact on the wildlife and humans living in the immediate are a big concern that no one seems to take seriously. The permit should be denied or conditioned upon transitioning to 100% renewable energy and closed-loop water infrastructure.

1. Elimination of Methane-Based Fuel Cells and Regulatory Loopholes
The proposed behind-the-meter microgrid relies on 2.45 GW of Bloom Energy fuel cells powered by natural gas (methane). This setup will emit over 10 million metric tons of CO2 annually. Operating behind the meter is a workaround to bypass the public grid and sidestep compliance with New Mexico's Energy Transition Act, which requires public utilities to transition to 100% zero-carbon electricity by 2045.

2. Compliance with State Climate Mandates
Allowing a private microgrid to emit millions of tons of greenhouse gases directly undermines Governor Michelle Lujan Grisham's Executive Order 2019-003, which mandates a statewide emissions reduction of at least 45% by 2030 and net-zero emissions by 2050. This private, off-grid project must not be exempted from the emission mandates that apply to the rest of New Mexico.

3. Transition to 100% Renewables (Solar and Storage)
Project Jupiter should be powered entirely by renewable energy. NMED must require the project to use solar arrays paired with battery energy storage systems (BESS), replicating the clean energy model successfully deployed at Meta's Los Lunas Data Center, which runs on 100% contracted solar and wind resources.

4. Public Health and Air Quality Harms
The proposed microgrid will emit approximately 150 tons of particulate matter (PM2.5 and PM10) and 37 tons of nitrogen oxides (NOx) annually in a region that already struggles with ozone and air quality. These emissions threaten the respiratory and cardiovascular health of local New Mexicans, particularly in vulnerable frontline communities.

5. Mandatory Closed-Loop Water Systems
In an arid, water-stressed desert environment, protecting local aquifers is a priority. NMED must mandate the use of strict, fully closed-loop water systems for all cooling infrastructure to prevent groundwater depletion and protect local water resources. NMED should deny Permit No. NSR 10883 unless the applicant commits to 100% renewable energy, integrates with a decarbonizing grid to comply with state law, and utilizes closed-loop water cooling systems.

As a resident of New Mexico, I don't believe New Mexico should host Data Centers. It is a strain on already tight resources, water and energy. Yucca, Oracle, Open AI and Project Jupiter h...↓ave shown they do NOT have New Mexican's best interests in mind. And they will continue to manipulate and pay to exploit our land and resources to line their pockets. The promises made are not enough to justify the harm that will be caused. They have also not worked in good faith. Paying people to harass and lie to residents and submit fraudulent comments.

I don't trust Project Jupiter and I think most residents also feel the same.

Data Centers need more regulation. They need to be held accountable, they need to pay for the energy and resources. That cost should not be passed on to residents since we do not see any benefit. New Mexicans are being exploited to continue to line the pockets of billionaires and oligarchs. All while the planet gets hotter and the Rio Grande runs dry.

Project Jupiter will emit more Greenhouse gas than Albuquerque, Las Cruces, and Santa Fe combined. They have failed to meet deadlines to submit proper jobs reports. If the reports were favorable I don't think they would have missed those deadlines. I believe they missed them because they failed to meet the proposed jobs they alleged they would provide to New Mexican's.

Along with everything above, data centers cause obscene noise pollution that would negatively affect people and wildlife. Would leech harmful forever chemicals into the soil and water systems It would raise day time and night time temperatures in the area. They would emit CO2 and Nitrogen Oxide increasing risk of asthma, cancer, and heart attacks to anyone in the area.

It would bring higher energy costs to local residents already facing possible increases should PNM be acquired by Blackstone (Open AI and Blackstone have a 10 billion dollar deal that should be considered a conflict of interest!). At a minimum Project Jupiter should pay for the entire cost energy and infrastructure required to support it.

TLDR Data Centers are a bad deal for New Mexicans and all data center construction should be halted and reevaluated to benefit the community and the land that they occupy, not the shareholders and companies only seeking to profit on the exploitation of the people of New Mexico

This massive influx of carbon dioxide equivalent directly undermines New Mexico's climate goals and threatens local air quality.

Water Depletion and Toxic Sludge: Beyond consuming massive quantities of local water, Project Jupiter relies on a proposed desalination plant to support its operations. The desalination process generates a highly concentrated, toxic sludge byproduct. Disposing of this hazardous waste threatens to poison local soil and delicate desert aquifers, exacerbating regional water scarcity.

Bloom Energy's Hazardous Waste Track Record: The decision to utilize Bloom Energy LLC fuel cells brings severe chemical hazards to New Mexico. Bloom Energy has faced heavy federal scrutiny, including an EPA hazardous waste probe and lawsuits alleging the company illegal dumped benzene, chromium, and lead into a public California landfill. Introducing a company known for generating and allegedly dumping these dangerous carcinogens and heavy metals poses an unacceptable public health risk to Doña Ana County.

Subversion of the Democratic Process: The New Mexico Department of Justice is currently conducting a formal investigation into widespread public comment fraud. Hundreds of supportive comments—including those under the names of local residents and state representatives—were fraudulently submitted without consent by pro-project canvassers.

Astroturfing and Dark Money Corporate Ties: The New Mexico State Ethics Commission has sued the unregistered entity "Elevate New Mexico" for running a deceptive, multi-thousand-dollar lobbying campaign to push this project. Public records have traced this "homegrown" front group directly back to APCO Worldwide, a powerful global public relations and lobbying firm. New Mexico communities refuse to be manipulated by out-of-state dark money and corporate astroturfing. New Mexico's finite natural resources must be preserved for its residents, not sacrificed for a corporate data center. I ask that NMED and state leadership halt further permitting for Project Jupiter.

Has there been or will there ever be upstream fuel testing of methane gas to anticipate the composition of these fuel cells' emissions? How exactly will NMED enforce emissions standards without direct, long-term, continuous monitoring? Or isolate their deleterious impact on air quality without an accurate assessment of localized pollution? A fuel cell can continue to generate electricity or maintain operating temperatures while experiencing catalyst degradation which causes a massive spike in the release of carbon monoxide or Volatile Organic Compounds (VOCs). This project would need to centralize the 2,275 individual stack emissions into an exponentially smaller number of exhaust systems so that Continuous Emissions Monitoring Systems (CEMS) installed on these central exhaust systems can provide real-time, accurate data about operational compliance. As it is, this design plan completely fails to provide monitoring conditions that are "practically enforceable" under 20.2.70.302.B NMAC. A proposal, such as this one, that relies on computer simulation modeling instead of actual, measured air pollution at scale is invalid, untrustworthy, and far from what residents of Doña Ana County and New Mexico deserve. What data was used to train these models? When and where was this data collected? What proportion of those involved in the development of this model have, at any time, received money from the corporations involved? How much? If NMED allows group testing for this project, 99% of the exhaust stacks at this facility will never be physically tested during the entire life of the Title V permit. This creates an unmonitored loophole that violates the Clean Air Act's mandate for continuous compliance.
We know the pollution approximations provided are based on an extremely lazy testing methodology and while we were not told whether these 4 tests were even done on-site or during peak temperatures, we can safely assume the applicants cut corners here as well in an attempt to fast track this approval. As I write this, Project Jupiter is draining an undisclosed amount of water from our shared aquifer on a daily basis. Given the st atistical invalidity of their pollution estimates, approving this air permit under any circumstance would be to allow this project to introduce unmitigated and undisclosed hazards into our air without consequence.
Children attending Santa Teresa Elementary School will sit innocently, every day, LESS THAN ONE MILE from this pollution. Three other schools, an elder care center, and three public parks sit within around 4 miles of this project. Deny this air permit. Gambling with the fragile health of our children and elders would be a complete defilement of the authority vested in you.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities.
The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. How am I supposed to send my kids to school knowing what they are breathing in? Knowing it can cause permanent brain damage or breathing complications before they have had a chance to grow up.
Fuel cells also create hazardous waste and the fuel cell provider for this project has a history of illegally dumping this waste and hiding it for several years. This company will likely repeat its bad habits, illegally dumping dangerous and undisclosed chemicals into our public landfills, and we will just have to wait until somebody notices? Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.
My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

Our county has and continues to face an illegal dumping epidemic so how can I be sure that these systemic oversight failures we have locally won't continue and expand to include this dangerous and experimental fuel cell operation. A fine for illegal dumping does not undo damage or its spread once our aquifer and soils are contaminated. It also will not re-capture the volatile chemicals that are released into the air when hazardous waste is improperly stored and disposed of.
My family's health and safety should be worth more than the profits of out-of-state corporations. The only defensible options moving forward are to deny this air permit or you must hold a public hearing in-person in Santa Teresa with a component for virtual participation. Materials and the hearing itself must be translated into Spanish and meet any other accessibility needs requested by community members.

A change to fuel cells has minimal impacts on the suffering we will endure as a result of the gas plant's air pollution. To add 10 million tons of carbon dioxide pollution and a vague estimate of toxic emissions to our active and long-time nonattainment zone would be nothing short of blatant environmental racism. Our metro area is currently 16th worst in the nation for ozone pollution and we have received a failing grade on this air quality standard every single year since 2000. We are already breathing some of the most compromised air in the country. It is unacceptable to invite a new source of hyperscale air pollution into our communities.
The carbon dioxide pollution alone will heat our atmosphere at a much faster pace and promote the formation of even more ground-level ozone. Last summer, my 7 year old suffered a grand mal seizure while on the playground at school because the extreme heat led to electrolyte imbalances. My brother works outside everyday without shade or rest breaks and has nowhere to keep his insulin cool. I can barely pay my electricity bills in the summer as it is. We cannot afford more intense heat. The other toxic air pollutants are extremely dangerous–many of them at very low levels. The Heat caused will make it unbearable for people to live and make living conditions miserable and unacceptable. Our atmosphere will suffer due to this. I've had experiences with heat exposure due to living in Albuquerque and having visited Las Cruces, near where the center is being built, will only make it more difficult for me to live there as regulating my body temperature is harder for some. This is environmental racism sponsored by the government. Everyone around this area will be exposed to harm one way or another. the water being used to cool down the systems is also a problem.
The air pollution caused will make living harder for the entire world. We need the ozone layer to stay alive and not die from space? This is destroying the planet. The fact this plan is the largest one built yet and is in the middle of the desert in a Relatively poor area is a big problem. There are cancer-causing chemicals being used, such as benzene, lead, arsenic, and chromium which poison the body, and Earth.
The water used takes it away from people who actually need it and would benefit from it. I do marching band, and am going to do it in college down there. If water turns bad (which has happened to other towns with data centers) Makes conditions unbearable and has people left with unclean water, unable to access anything else if left with that. It is completely unsafe to do a AI project down here as most people (including myself) have financial issues and cannot afford basic necessities. Having the most basic need taken from generative AI is humiliating to say the least. How can this be done?

The Rio Grande River is currently dry due to the heat wave going on right now and adding more heat due to the way the systems work is disgusting and a power trip. Public Hearings must be held, especially in the areas where it is occurring, for the people to get the best representation for their town with time to adjust and review the air quality permit.

The material conditions for nearby residents are already tenuous. Most are already navigating multiple social determinates of health and structural starvation. Not only should this project not exist, it should not exist in intentionally exploited communities. There is no both/and. There is no nuance. Permit or no permit, nothing impacting this community should advance without direct input from this community. Public hearings - in English, Spanish, ASL/CART, in person, and virtual must be held- publicized well in advance and often. Model the moral courage all ethical decisions require. Environmental racism, the further extraction of resources on violently stolen land, the influencer to billionaire profiteering, and the literal death sentences are all connected to...you guessed it...a rise in authoritarianism. I said what I said and I will keep saying it. Because you are grown enough to hear it and smart enough to end the grift. Give the residents of Doña Ana County and the people of New Mexico something to truly thank you for. Project Jupiter isn't it.
