This comment period is open for 45 days, from April 23, 2026, through June 8, 2026.


NMED issued a Public Notice on April 23, 2026, to announce the beginning of a 45-day comment period in accordance with 20.4.1.900 NMAC. Any person who wishes to comment on the draft Permit and/or request a public hearing should submit a written comment, through NMED’s Public Comment Portal or by email or by postal mail, as detailed in the NMED Agency Initiated Modification (AIM) Public Notice and Fact Sheet. Please include the commenter’s name, and postal or email address. Only comments and/or requests for a public hearing received before 5:00 p.m. MT on June 8, 2026 will be considered.
Please reference the NMED AIM Draft Permit.
Written comments should include, to the extent practicable, all referenced factual materials. Documents in the Administrative Record need not be re-submitted if expressly referenced by the commenter.
Requests for a public hearing shall provide: (1) a clear and concise factual statement of the nature and scope of the interest of the person requesting the hearing; (2) the name and address of all persons whom the requestor represents; (3) a statement of any objections to the draft Permit, including specific references to any conditions being modified; and (4) a statement of the issues which the commenter proposes to raise for consideration at the hearing. Written comments and/or requests for a public hearing must be submitted by 5:00 p.m. MT on June 8, 2026. NMED will provide a thirty (30) day notice of a public hearing.
