XTO Energy Inc. - Cowboy Central Delivery Point (CDP) Alternative Compliance Plan

Alternative Compliance Plans – Pursuant to 20.2.50.113.B(10) NMAC, an owner of affected facilities may submit a request for an alternative compliance plan (ACP) for the fleet of engines and turbines owned by the company. The purpose of the ACP is to demonstrate that, while each engine or turbine cannot meet the individual emission standards in the rule, overall the fleet will meet the standards. A 30-day public comment period begins when the Department posts the request on its website (posted 5/18/2026). Comments received will be forwarded to the owner for a response.

Comments submitted via the Public Comment Portal, emailed to ENV-AQB-OPR-Public.Comments@state.nm.us, or mailed to the address in the notice are considered written.

All interested persons have thirty (30) days from the date the notice is published in the newspaper to notify the Department in writing of their interest in the permit application. Comments submitted via the Public Comment Portal, emailed to the permit writer, or mailed to the address in the notice are considered written.
