Ozone Precursor Rule - Revised Alternative Compliance Plan Proposal - Kinder Morgan

Revised Alternative Compliance Plans – Pursuant to 20.2.50.113.B(10) NMAC, an owner of affected facilities may submit a request for a revised alternative compliance plan (ACP) for the fleet of engines and turbines owned by the company. The purpose of the revised ACP is to demonstrate that, while each engine or turbine cannot meet the individual emission standards in the rule, overall the fleet will meet the standards. A 30-day public comment period begins when the Department posts the request on its website (revised ACP posted 2/4/2025). Comments received will be forwarded to the owner for a response.

All interested persons have thirty (30) days from the date the notice is published on our website (revised ACP posted 2/4/2025) to notify the Department in writing of their interest in this revised alternative compliance plan. Comments submitted via the Public Comment Portal, emailed to ENV-AQB-OPR-Public.Comments@state.nm.us , or mailed to the Air Quality Bureau (525 Camino de los Marquez, Santa Fe, New Mexico 87505, Attn: Compliance & Enforcement Manager) are considered written.
